Collin County District Judge Suzanne Wooten sentenced to 10 years probation

Well, one thing has become obvious. A contributing factor as to why the Rogers case has been delayed 10 times in a row (maybe 11 if the February 20th trial gets delayed) is the dang-gum judge, rightly or wrongly, was indicted, convicted and is no longer a sitting judge for the 360th district court of Texas!

Here, Judge Wooten appears to be sporting a similar white bath robe as worn by the subject of this blog in his mug shot.

By now its old news..yet, here's the story from November 29th, 2011 by by Dan Eakin of Star Local News.

District Judge Suzanne Wooten was sentenced to 10 years probation and a $10,000 fine Monday after having been convicted last week of bribery and other charges.

She also will be required to perform more than 1,000 hours of community service while on probation.
The jury arrived at 8:30 a.m. Monday, expecting to hear prosecutors the next two days arguing what sentence she should receive, and the defense arguing one day that the sentence should be less than what prosecutors would be asking.

After waiting to be brought into the courtroom, the jury was informed that, over the holidays, the state and defense had reached an agreement on the sentence and the fine.

Visiting District Judge Kerry Russell agreed to the sentence on condition that Wooten would acknowledge her guilt and waive the right to appeal. After Wooten did so, the judge signed the necessary papers for the conviction, sentence, and fine. The jury was then brought into the courtroom, given an explanation and dismissed, with the judge thanking the jurors for their service.

After hearing more than two weeks of testimony, the jury convicted Wooten last week, and the judge had set the sentencing phase to begin Monday morning. With the agreement worked out between the state and the defense, the sentencing phase became unnecessary.

Per the agreement, Wooten was sentenced to 10 years probation on each of eight charges, to run concurrently, including six counts of bribery, conspiring to engage in criminal activity and money laundering. She was sentenced to five years probation for tampering with a government record, also to run concurrently.
Following the signing of the agreement Monday, Wooten's attorney, Peter Schulte, who defended Wooten along with Toby Shook, said, "We are disappointed in the jury's verdict. However, Judge Wooten is ready to move on with her life."

The agreement also makes Wooten immediately cease her duty as the 380th District Court judge. She had been suspended, receiving full pay, while awaiting trial.

The next hurdle Wooten must overcome will likely be a hearing before the state bar on whether she should be disbarred, meaning her license would be taken away and she could no longer legally practice law in Texas.

"The disbarment is not automatic," Schulte said. "She will have the right to be heard." Should she be disbarred, Wooten could still work as a mediator, a paralegal, or in other areas related to the practice of law.

Wooten holds a law degree from St. Mary's School of Law in San Antonio.

During the lengthy trial, the state alleged that David and Stacy Cary had funneled six amounts totaling $150,000 into the checking account of James Stephen Spencer, Wooten's campaign manager, to finance Wooten's 2008 campaign as bribes to get Wooten to rule in their favor in a child-parent relations case.

Had Wooten taken the case, which she did not, she would have had to rule on whether David Cary would have been required to pay his ex-wife, Jennifer Cary, more than $400,000 in a divorce settlement.
Harry White, who with Adrienne McFarland prosecuted the Wooten case as members of the Texas Attorney General's staff, promised that he would also bring the Carys and Spencer to trial in relation to the same case.

Stacy Cary is expected to go on trial first, possibly in January. Spencer is expected to be tried next, and David Cary last.

43. In January 2006, Clark told Rogers that Clark had invested with Global Finance and was receiving profits from Global Finance’s program. In fact, drawing from the representations in Davis’s December 20, 2005 joint venture amendment, Clark represented to Rogers that he had $100 million invested in the Global Finance investment program.

44. In February 2006, after Rogers expressed an interest in participating in Global Finance’s program, Clark introduced Rogers to Davis. According to Rogers, Davis offered him a “totally secure” high-yield program involving the purchase and sale of bank debentures that paid monthly returns of up to 25 percent. Davis touted the fact that the funds would be safely deposited in an attorney’s trust account and would not be withdrawn until an actual transaction commenced or an instrument was purchased.

45. In February 2006, Rogers was the managing member of Level Par and its sole contact with Global Finance. Rogers, using Level Par as a pooling vehicle, conducted an offering, and invested the proceeds with Global Finance. Based on Davis’s representations, Rogers prepared Level Par’s offering documents, promising investors monthly returns ranging from three to 10 percent. Rogers orally represented to Level Par investors that their principal was not at risk because it remained in an attorney’s trust account. Rogers also told investors that the funds would be used as collateral to trade in various bank debentures or mortgage backed securities. Rogers told one investor that “the World Bank would have to collapse to lose his investment.” Rogers raised $4.7 million from approximately 35 investors and wire transferred all of it to Global Finance in February and March 2006.

46. Rogers knew that Davis’s claims were fraudulent. First, Rogers was an investor in Correll’s scheme, a similar high-yield investment program, which had ceased making promised payments. Also, Rogers was on notice that these investments were scams when he learned of the Commission’s allegations in the Correll civil action in which Robbie Gowdey, Rogers’s friend and neighbor, was charged with violations of the federal securities laws.

47. Nevertheless, on February 13, 2006, Rogers caused Level Par to enter into a joint venture agreement with Global Finance, and a trust account agreement with Dippolito, containing terms similar to Clark’s and Schliemann’s agreement with Davis.

In the end, many investors we talked with have never gotten ONE PENNY of money back from the Level Par investment. In the meantime, has Rogers curbed his fund raising activities? NO. But surely he's seen the light and now enables his investors to rake in huge profits to rebuild his reputation as a rain-maker, right?

It's interesting to point out she was indicted in July of 2010 for violations between 2007 and 2009. Her trial and conviction was announced on November 11th, 2011--16 months after her indictment.

Kelly G Rogers was indicted in July of 2009 for violations having occurred in Spring of 2005. As you know, his trial has been postponed TEN TIMES. It's now at 29 months and counting since his indictment. Gee, I wonder if the Judge was concerned about herself and not her other cases?

The Governor of Texas will appoint a new Judge to take the post until the elections of 2012. Make sure this new Judge gets a warm welcome from the friends of Kelly G Rogers with a stack of letters asking for the immediate trial of this indicted Lawyer of Dallas, TX.

Is this getting old or what?

For the TENTH TIME IN A ROW, since July of 2009, Judge Suzanne Wooten has allowed Kelly G Rogers and his lawyer-John Charles Hardin to delay his trial.

The new trial date (Yea, Right) is February 20th, 2012. You got it, almost SIX years after the $435,000 had disappeared from the corporate coffers, another trial date is on file and pending.

In State of Texas v Kelly G Rogers, the State is claiming that Kelly Gordon Rogers removed $435,000 from an oil and gas company in 2006.

Fast forward to 2011 and he's still wheeling and dealing in the Oil and Gas business. In a previous story, it was disclosed by the State of Nevada that Rogers reactivated Falcon Ten Energy, LLC., to presumable conduct more oil and gas deals.

Kelly G Rogers, Indicted by the State of Texas and set to stand trial on December 12th, is on the move again. In checking with our friend Ross Miller, Nevada Secretary of State, Kelly Gordan Rogers--Attorney Dallas, TX has activated a revoked LLC called Falcon Ten Energy, LLC--E0185712007-8.

The LLC was reinstated on August 25th, 2011 when money was paid to the registered agent INCORP SERVICES, INC at 2360 CORPORATE CIRCLE STE 400 in Henderson, NV 89074.

So why create an LLC in Nevada? One reason--Nevada has long been known as a state committed to maintaining privacy and flexible corporate management.

It's interesting if you check out WHEN he re-instated the LLC--on August 25th, 2011, he listed his address at 8 Riva Ridge, Frisco, TX. However, Kelly G Rogers and Carrie S Rogers had been foreclosed on by the Bank of Texas on September 7th of 2010....TEN months PRIOR to him updating this LLC.They had long moved out and we're renting a home in the same neighborhood in Frisco, TX.

The Bradley Dean case is stereo-typical of a Kelly G Rogers deal. You end up getting to know Kelly Rogers from church, the local community or a friend of a friend. You think he's sharp and impressive. One day, he contacts you with this fantastic opportunity. He has a scheme, he comes out and pitches it and it sounds really good...so you invest.

However, over time, you begin to notice that NOTHING he promised in the original pitch is working out. You begin to ask questions and eventually it hit you up side the head--this deal is a scam. You scramble to get your money---only to find that it's long gone.

You file a lawsuit, hire expense attorney's and eventually run out of money pursuing justice. In the meantime, Kelly G Rogers represents himself or Carrie S. Update: State of Texas v. Kelly G. Rogers

This time it's different.

This time it would appear the trial of Kelly G. Rogers will proceed with a pretrial conference on December 7th and the trial scheduled on December 12, 2011.

This time an agenda has accompanied the subpoenas sent to SEVEN individuals who will testify against the actions of Kelly G. Rogers. These agendas have never been forwarded with previous subpoenas so something is different this time around.

John Charles Hardin will face off against the DA's office to see who can prove their point.

Can Hardin convince anyone that $435,000 taken from the company was some type of compensation for Kelly Rogers hard work? Or will the DA prove it's just another investment scheme propagated by Rogers Ala: Rio Grande Coal Mine, LLC v Kelly Rogers, Carrie Rogers, Bradley Dean v. Arbitration Undone: 5th Circuit Overturns Awards Against Weyand and Thiessen

The story behind this original suit was all about getting even. If you look closely; KCR Investors stood for "Kelly and Carrie Rogers" and this original lawsuit was all about getting Richard Weyand.

However, this ruling had to be a stunning blow to KCR Investors and other family members trying to nail Richard Weyand to the wall.

The back story to all of this is Rogers and Weyand began their partnership back in 2004. As they developed ideas together, Rogers began soliciting friends, family and acquaintances for money to back these schemes. Rogers also wrote the subscription agreements.

In late winter of 2006, the SEC contacted the company to advise a deposit was made into an individuals bank account who was part of an ongoing SEC investigating associated with the Travis Correll Ponzi scheme. That's when all hell broke lose.

Rogers was named in SEC vs. Global Finance and Investments, Inc--case No; 4:07cv346. Since that time, the lawsuits have been flying against Rogers and Weyand. However, this arbitration award levied a whopping $13,317,381 against Weyand, $311,329 against Theissen and $730,123 against Rogers.

However, the 5th circuit concludes that Weyand and Theissen cannot be held personally liable for the judgement and has overturned the Arbitration award.

As noted in the footnotes of page 4: The arbitration panel also held another individual defendant, Kelly G. Rogers, liable for a total of $730,123. Rogers is not a party to this appeal.

When litigants attempt to vacate arbitration awards, they usually don't get much help from the 5th U.S. Circuit Court of Appeals. Yet the court recently ruled that two defendant corporate officers were not individually bound by arbitration agreements and overturned the awards against them.

The Aug. 4 decision in DK Joint Venture 1, et al. v. Richard W. Weyand, et al. is a departure for the appeals court, which has been hostile to arbitration vacatur attempts in the past. For example, in 2009's Citigroup Global Markets Inc. v. Bacon , the court ruled that arbitrators' manifest disregard of the law was not a ground for vacatur. And in 2007's Positive Software Solutions Inc. v. New Century Mortgage Corp., et al., the 5th Circuit, sitting en banc, reversed a three-judge panel decision that had affirmed a U.S. District Court ruling vacating an arbitration award. The en banc court found that the "mere appearance" of an arbitrator's bias was not a sufficient reason for vacatur.

According to the 5th Circuit's opinion, the background in Joint Venture 1 is as follows: The plaintiffs sued Weyand, Peter Thiessen and 15 corporations controlled by them in state court over a business dispute. Weyand is the chief executive officer and Thiessen is the chief financial officer of the defendant companies. The plaintiffs and the defendant corporations had entered into contracts called "subscription agreements" that contained arbitration agreements. The plaintiffs moved to compel all the defendants to arbitrate the state court litigation. [See the court's opinion.]

The defendants removed the case to a U.S. District Court for the Northern District of Texas. While Weyand and Thiessen protested that they had not agreed to arbitrate anything, the District Court ruled that all of the defendants including Weyand and Thiessen were bound by the arbitration agreements, the 5th Circuit wrote.

Specifically, U.S. District Judge Ed Kinkeade of Dallas ruled in a Jan. 29, 2008, order that because Weyand and Thiessen conducted the day-to-day business affairs of the corporate defendants, they met the definition of "affiliate" in the subscription agreements, even though they didn't sign them.

"Moreover, under Texas law, where contracting parties agree to arbitrate all disputes 'under or with respect to' a contract, they generally intend to include disputes about their agents' actions," Kinkeade wrote in the order.On April 1, 2009, a panel of three American Arbitration Association arbitrators awarded the plaintiffs $13,317,381 in damages against Weyand and $311,329 in damages against Thiessen, the 5th Circuit wrote. After the District Court confirmed the award, both men appealed.

In a May 24, 2010, brief to the 5th Circuit, the plaintiffs argued that the question of whether Weyand and Thiessen agreed to arbitration was delegated exclusively to the arbitration panel and "no court has the power to decide that issue." The plaintiffs also maintained that Weyand's and Thiessen's arguments were "without merit, without justification, and legally frivolous."

But the 5th Circuit disagreed. "Weyand and Thiessen, as CEO and CFO of the defendant corporations, were the corporations' agents. Under general principles of contract and agency law, the fact that the defendant corporations entered into the Subscription Agreements did not cause their agents, Weyand and Thiessen, who acted only as officers on behalf of the corporations, to be personally bound by those agreements," wrote 5th Circuit Judge James Dennis in an opinion joined by Judges Eugene Davis and Jacques Wiener. The panel reversed the trial court's order confirming the award and remanded it back for further hearings.

Donovan Campbell Jr., a partner in Dallas' Rader and Campbell who represents the plaintiffs in DK Joint Venture 1 , did not return a telephone call seeking comment.

Jeff Boggess, a Frisco solo who represents Weyand and Thiessen, is pleased with the decision — especially given the 5th Circuit's reputation for rejecting attempts to vacate arbitration awards.

"The 5th Circuit's decision is a beacon to wayward federal district judges and others who misinterpret Texas state decisions that decide which agents of contracting principals can be bound by the principals' arbitration agreements and under what circumstance," Boggess

Five Reasons why Judge Suzanne Wooten SHOULD NOT GRANT another continuance to Kelly G. Rogers--Frisco Lawyer.

We're coming up on the moment of truth for Kelly G Rogers, Frisco Lawyer. Less that TWO weeks until he stands trial after he was indicted in July of 2009. Here we are--some TWO years later and we're still not assured of a trial.

While we fully expect Kelly Rogers--Dallas Lawyer--to request ANOTHER continuance, we at the Kelly Rogers Report have FIVE REASONS why we are begging Judge Suzanne Wooten to stand firm and move the trial forward as scheduled.

Eight Trial Dates Have Come and Gone: How much time does someone need to prepare for trial? Yet, the court has passed trial dates on EIGHT different occasions: October 29th, 20009, December 3rd, 2009, January 15th, 2010, March 19, 2010, May 25th, 2010, July 14th, 2010, November 3rd, 2010 and April 13th, 2011. Frankly, we're questioning the competency of the Collin County DA's office here. So let's keep this date...

Justice Needs to be Served: Many who read this blog each week have one thing on their mind--watching justice served to Kelly G Rogers--Frisco lawyer. Many have lost everything as a result of investing with this guy. He's as slippery as a bloated codfish and seems to lye his way out of everything. It's never his fault. Well, this time it is his fault and we need to see him served.

Kelly G Rogers Needs to do some Jail time: It's not clear what the sentence is for a first degree Felony for Misapplication of funds. However, it's important that Kelly G Rogers be humbled by serving time and being labeled a convicted felon. Maybe then he will be humbled...although it's doubtful. Until he serves jail time, he will continue to be a "Get-Rich-Quick-Schemer" that is always looking at how to make a fast buck--regardless of who he hurts or what rules he breaks. No remorse. No fair play. No team of advisers. Just complete and unadulterated arrogance.

Kelly G Rogers needs to be Disbarred: Lawyer. It's a title he flashes around like a "Get out of Jail Free" card. It gives him the self promotion and credibility he needs to scam people into thinking he's someone special. They're impressed, they invest, Rogers moves the money somewhere other than where it should be, the investor sues and Rogers represents himself at nominal costs. However, the investors are forced to pay an outside Lawyer $150-$250 per hour to find their money. If Rogers is convicted of a felony and disbarred, he'll then need to come up with his own money to defend all these lawsuits. It would level the playing field and safeguard the public by taking away his title and ability to bully his opponents and manipulate the legal system.

Need to put an End to this Case and Move on: We've all been watching the development of this of this case since 2009. An evidentiary panel of the District 7 Grievance Committee found that Phillippi entered into a business transaction with a client without obtaining the client’s consent in writing. Phillippi also engaged in conduct involving dishonesty, fraud, deceit, or misrepresentation. Phillippi violated Rules 1.08(a)(3) and 8.04(a)(3). He was ordered to pay $7,077.13 in attorney’s fees and costs. Phillippi has filed an appeal.

RESIGNATIONS

On March 29, the Supreme Court of Texas accepted the resignation, in lieu of discipline, of David Lee Murff [#24039081], 41, of Houston. At the time of Murff ’s resignation, there were three matters pending against him alleging neglect and failure to communicate, to place client funds into a trust account, to promptly deliver to the client or third person any funds or other property that the client or third person is entitled to receive, to return client files and unearned fees at the end of representation, and to timely furnish to the Chief Disciplinary Counsel’s office a response. Murff violated Rules 1.01(b)(1), 1.03(a), 1.14(a) and (b), 1.15(d), and 8.04(a)(8). On May 9, the Supreme Court of Texas accepted the resignation, in lieu of discipline, of Olesya Oleynik [#24062927], 25, of Sunnyvale, Calif. The Court found that during two representations, Oleynik neglected the legal matter entrusted to her; failed to keep the clients reasonably informed about the status of their matters; and engaged in conduct involving dishonesty, fraud, deceit, or misrepresentation. Oleynik violated Rules 1.01(b)(1), 1.03(a), and 8.04(a)(3).

On April 8, Sidney Allen Lyle, Jr. [#00795026], 41, of North Richland Hills, received a two-year, fully probated suspension effective May 1. An evidentiaryand the remainder probated. An evidentiary panel of the District 15 Grievance Committee found that in connection with three grievances, Lyle neglected client matters; failed to communicate with clients; made false statements of material fact or law to a third person; engaged in conduct involving dishonesty, fraud, deceit, or misrepresentation; and failed to respond to a grievance timely. Lyle violated Rules 1.01(b)(1), 1.03(a), 4.01(a), and 8.04(a)(3) and (a)(8). He was ordered to pay $3,000 in attorney’s fees and expenses and $12,500 in restitution.

On May 12, Bret Christopher Green [#24027210], 43, of San Antonio, accepted a five-year, partially probated suspension effective Jan. 29, 2012, with the first two years actively served and the remainder probated. An evidentiary panel of the District 10-4 Grievance Committee found that Green failed to refund unearned fees, to return his client’s file, to provide written notice to his client that he was suspended from the practice of law, and to deposit and hold unearned fees in a trust account. Green violated Rules 1.04(a), 1.14(a), 1.15(d), and 8.04(a)(3) and (a)(7). He was ordered to pay $1,500 in attorney’s fees and expenses and $13,500 in restitution.

On May 27, Charles P. Jones [#10866900], 63, of San Antonio, received a two-year, partially probated suspension effective June 15, with the first year actively served and the remainder probated. The 285th District Court of Bexar County in San Antonio found that Jones made a misrepresentation to his client and failed to keep his client reasonably informed, to respond to reasonable requests for information, to promptly return unearned fees, and to return the client’s file. Jones violated Rule 1.01(b), 1.03(a), 1.15(d), and 8.04(a)(3). He was ordered to pay $1,000 in attorney’s fees and expenses and $600 in restitution.

REPRIMANDS

On May 11, John K. George [#07805600], 63, of Bellaire, accepted a public reprimand. An evidentiary panel of the District 4-C Grievance Committee found that George was hired in August 2007 for representation in a real estate matter and agreed to represent his client in negotiating a settlement with the buyer for missed payments and, if necessary, to initiate foreclosure proceedings proceedings. The client periodically contacted George to ascertain the status of the case and was told by George that he had begun the foreclosure proceedings when in fact, he had not. In April 2010, George admitted to his client that he had not pursued the foreclosure action. George violated Rules 1.01(b)(1) and 8.04(a)(3). He agreed to pay $500 in attorney’s fees.

Casey Anthony get 4 years for Lying

Casey Anthony will be released from the Orange County Jail on July 13. Chief Judge Belvin Perry sentenced Casey Anthony this morning for lying to police, giving her four years in jail and credit for the time she's already served since 2008.

Considering how much time she's already served, court officials have calculated that she will be released from the Orange County Jail July 13. The sentence also includes four, $1,000 fines for each of the four counts of lying to police.

The sentence is the maximum Perry could impose under the jury's decision.

But unhappy Anthony opponents still gathered outside the courthouse to express their displeasure about her acquittal Tuesday on a charge of first-degree murder in connection to her daughter's death.

"I feel she got away with murder and it really irritates me," said Donna Marini, an Altamonte Springs woman who attended most of the trial proceedings.

Nearby her, though, Casey Anthony supporters chanted for her release. One many stood with a sign asking "Casey will you marry me?"

"I would date her," said the sign's holder Tim Allen. "Everyone deserves a second chance."

Inside the courtroom, Anthony showed no reaction while Perry discussed her lies and imposed his sentence.

Earlier, she arrived in Perry's courtroom appearing relaxed and happy.

All of Anthony's lies

Anthony, who normally wears her long hair in a bun on top of her head, wore her hair down in court today. She huddled with her attorneys, Cheney Mason and Dorothy Clay Sims, while smiling and stroking her hair before the hearing began.

Her smiles disappeared though after she learned Judge Perry's sentence.

Perry disagreed with Lisabeth Fryer, one of Anthony's attorneys, who argued that Anthony's four convictions for lying to police should be consolidated into one count.

That's because all the lies were told in one conversation, Fryer said.

Fryer noted that the concept of "double jeopardy" should be applied. She wanted Perry to sentence Casey on one charge because the false statements Anthony gave law enforcement stem from a single incident on July 16, 2008.

She also noted case law to support her argument.

Assistant State Attorney Linda Drane Burdick disagreed, saying "It is our position that there is a temporal break between the lies.

Burdick says Casey's lies were intended to lead law enforcement "on a wild goose chase."

She says she did have time to pause and reflect about these mistruths and they did not occur in one single instance.

Perry agreed with Burdick that Casey's guilty verdicts represented "four separate and distinct lies" that led law enforcement on months-long search for her daughter Caylee, forcing them to spend "a great deal of time, energy and man power looking" for the child."

Just as the jury spoke loud and clear about finding Casey not guilty of the most serious charges against her, including the murder of her child, Perry said, "the jury spoke loud and clear as to the remaining counts, four, five, six and seven."

Hearing on costs set for Aug. 25

Earlier, Burdick let Perry know about the state's interest in collecting investigative costs from Anthony related to the search for Caylee Marie in 2008.

A hearing on that issue was set for Aug. 25.

Perry also told Anthony that she has a right to appeal his sentence for her lying convictions. Perry said the defense has 30 days to appeal.

Perry says if she does not file timely notice of appeal, she forfeits her ability to appeal.

Court is in recess right now as officials calculate the amount of credit she should receive for time she's already served in jail. That will determine how long she will be held at the Orange County Jail.

Outside the courthouse

Meanwhile, protestors upset with Anthony's acquittal on more serious charges, including murder, are chanting outside the courthouse. Some spectators also expressed support for Anthony, including one man who wants to marry the single woman.

A minority of protesters outside the courthouse shouted: "Free Casey!"

Earlier, at least two deputies were seen at the Orange County Courthouse carrying gas masks in anticipation of a strong reaction following this morning's sentencing.

Other officers are patrolling on horses.

Public outrage has been building since Anthony was acquitted Tuesday of first-degree murder and other serious charges in connection with her daughter's death in 2008.

Crowds gathered around two designated free-speech zone, where several people stood with home-made posters and signs. Several of those expressed disproval of Casey Anthony's verdict.

One poster had a picture of Anthony with silver duct tape over her mouth. One man was wearing duct tape over his own mouth. Other signs were directed at Caylee, such as one that said "We love you."

Other spectators gathered to photograph and videotape the crowd.

Patti Lockwood of Orlando, who said she's followed the Anthony case since day one, stood nearby and watched the crowd.

"I'm down here to see what kind of time she's going to get," Lockwood said of Anthony's sentencing.

Calls to theOrange County Sheriff's Office about its preparations have not been immediately returned.

'I don't feel like justice was served'

About 50 people gathered peacefully outside the courthouse this morning for today's milestone moment.

The scene outside the courthouse this morning seemed relatively normal -- spectators who were lucky enough to get tickets Wednesday lined up as they have for weeks.

Debbie Calderon and her daughter Kristelle Calderon of Ocoee were numbers 23 and 24 in the line.

They have been to the courthouse a few times before -- Kristelle, who wants to be a prosecutor, was hoping to get a glimpse of Nancy Grace.

The mother and daughter watched the trial regularly.

"She's guilty," Debbie Calderon said. "I don't feel like justice was served."

Ex-Illinois governor convicted of corruption

CHICAGO | Rod Blagojevich, who rode his talkative everyman image to two terms as Illinois governor before scandal made him a national punch line, was convicted Monday of corruption charges, including the incendiary allegation that he tried to sell or trade President Barack Obama’s Senate seat.

Blagojevich had spent 2 1/2 years professing his innocence on reality TV shows and later on the witness stand. He faces up to 300 years in prison, although federal sentencing guidelines are sure to significantly reduce his time behind bars.

The verdict appeared to be the conclusion, at last, to the spectacle of Blagojevich’s political career, which began its descent shortly after Obama was elected president in November 2008.
A month after Election Day, Blagojevich, who was required to name a senator to replace Obama, was arrested, and federal agents revealed that they had secretly recorded hundreds of hours of damaging phone calls by him and his advisers.

Blagojevich was accused of trying to secure campaign contributions, a cabinet post or a high-paying job in exchange for his official acts as governor. Blagojevich was acquitted on one charge of bribery, and the jury deadlocked on two counts of attempted extortion, but convictions came on the bulk of the counts and on those related to the Senate seat — the claims that had drawn international headlines.
After hearing the verdict, Blagojevich turned to defense attorney Sheldon Sorosky and asked, “What happened?”

The former governor spoke only briefly as he left the courthouse.

“Well, among the many lessons I’ve learned from this whole experience is to try to speak a little bit less, so I’m going to keep my remarks kind of short,” Blagojevich said.

Blagojevich becomes the second straight Illinois governor convicted of corruption. His predecessor, George Ryan, is serving 6 1/2 years in federal prison.

The case exploded into scandal when Blagojevich was awakened by federal agents on Dec. 9, 2008, at his Chicago home and was led away in handcuffs. “The conduct would make Lincoln roll over in his grave,” U.S. Attorney Patrick Fitzgerald said after the arrest.

Blagojevich, who was also accused of shaking down businessmen for campaign contributions, was swiftly impeached and removed from office. Fitzgerald pledged to retry the governor after the first jury deadlocked on all but the least serious charges.

This time, the 12 jurors voted to convict the 54-year-old Blagojevich on 17 of 20 counts after deliberating nine days. He also faces up to five additional years in prison for his previous conviction of lying to the FBI.

The jurors agreed with prosecutors that Blagojevich had tried to sell the Senate in a variety of ways, including an attempt to steer it to U.S. Rep. Jesse Jackson Jr. in exchange for $1.5 million in campaign cash promised by Jackson supporters.

After his arrest, Blagojevich called federal prosecutors “cowards and liars.”

In what many saw as embarrassing indignities for a former governor, he sent his wife to the jungle for a reality television show, “I’m a Celebrity, Get Me Out of Here,” where she had to eat a tarantula. He later showed his own ineptitude at simple office skills before being fired on Donald Trump’s “Celebrity Apprentice.”

In the second trial, attorneys for the former governor put on a defense — highlighted by a chatty Blagojevich taking the witness stand for seven days to portray himself as a big talker but not a criminal.

Blagojevich seemed to believe he could talk his way out of trouble from the witness stand. Indignant one minute, laughing the next, seemingly in tears once, he endeavored to counteract the blunt, greedy man he appeared to be on FBI wiretaps.

He told jurors his talk on the wiretaps merely displayed his approach to decision-making: to invite a whirlwind of ideas — “good ones, bad ones, stupid ones” — then toss the ill-conceived ones out. To demonstrate the absurdities such brainstorming could generate, he said he once considered appointing himself to the Senate seat so he could travel to Afghanistan and help hunt down Osama bin Laden.

Other times, when a prosecutor read transcripts where Blagojevich seems to speak clearly of trading the Senate seat for a job, Blagojevich told jurors, “I see what I say here, but that’s not what I meant.”
Among the tapes played for jurors was his infamous rant: “I’ve got this thing and it’s f---ing golden, and I’m just not giving it up for f---ing nothing. I’m not gonna do it.”

Former vice presidential nominee John Edwards was indicted Friday on charges of violating federal election law for allegedly using nearly $1 million in illegal campaign donations to conceal an extramarital affair during his 2008 run for the Democratic presidential nomination.

The former U.S. senator from North Carolina was charged in a six-count indictment with conspiring to receive the contributions from political donors and using them to hide his mistress, Rielle Hunter, and her pregnancy from the public so his campaign would not be damaged. Edwards lost the nomination to Barack Obama, then a senator from Illinois, and the affair’s subsequent exposure destroyed Edwards’s once-promising political career.

The indictment, returned by a federal grand jury in North Carolina, says the illegal contributions paid for Hunter’s living and medical expenses, along with travel needed to shield her from reporters. Prosecutors said this violated federal election laws that limit individual contributions to a campaign and require reporting of donations.

“We will not permit candidates for high office to abuse their special ability to access the coffers of their political supporters to circumvent our election laws,’’ said Lanny A. Breuer, assistant attorney general for the Justice Department’s Criminal Division. “Our campaign finance system is designed to preserve the integrity of democratic elections — for the presidency and all other elected offices — and we will vigorously pursue abuses of the kind alleged today.”

Lawyers for Edwards were expected to speak to reporters when the former candidate appears in U.S. District Court in Winston-Salem, N.C., on Friday afternoon. They have indicated they will vigorously fight the charges. Edwards lawyer Gregory B. Craig last week strongly denied any illegal activity by Edwards and accused prosecutors of exaggerating the strength of the allegations.

“John Edwards has done wrong in his life — and he knows it better than anyone — but he did not break the law,” Craig wrote last week. “The Justice Department has wasted millions of dollars and thousands of hours on a matter more appropriately a topic for the Federal Election Commission to consider, not a criminal court.”

In response to the indictment, Craig said Friday that Edwards “will tell the court he is innocent of all charges, and will plead not guilty.” He again denied that Edwards broke the law and said he “will mount a vigorous defense.”

The Edwards legal team on Friday also released statements from his 2008 campaign counsel and a former Federal Election Commission chairman disputing the charges.

“It is my view that . . . these payments would not be considered to be either campaign contributions or campaign expenditures within the meaning of the campaign finance laws,” wrote former FEC chairman Scott E. Thomas.

Echoing what attorneys for Edwards have said, he added: “I believe that the theory on which the government intends to base its prosecution is without precedent in federal election law.”

The pinnacle of success?

"When you solve a case and you’re working for yourself, there’s always the question of whether your client will pay you or not,” says Kelly. “I was always stressed because of money, or because I had money but no time to enjoy it.”

“We never saw him,” says Carrie, referring to herself and their children. “All I could see down the road was the kids and me having plenty of fun, with Kelly always missing from the picture. We wanted to have fun as a whole family.”

Then, a long-time friend showed them the business opportunity powered by Quixtar.

“We trusted these people,” says Carrie. “They listened to us. They showed us a way to get what we wanted, and then they led by example.”

“The first year we were in business, Carrie found a lump in her throat. “We discovered she had thyroid cancer. We had to keep moving even though there were two surgeries and the treatment to go through,” recalls Kelly. “Then we got pregnant, which was a real blessing – and, more responsibility.”

“You just have to learn to juggle your family obligations with the business opportunity,” says Carrie. “Lots of women stress out trying to work the business and keep a perfect house, etc.”

Instead, Carrie suggests leaving behind the small stuff. “Will it really matter, long term, if your house isn’t completely pulled together?” she asks. “There are more important questions to ask yourself: Are you happy with your life? Are you spending quality time with your family? Those are the priorities. Your house can wait.”

So their house is still in need of some remodeling. “We reached one goal, and that was to make our future more secure. Our next is to finish making our house what we want it to be,” says Carrie. “That’s my approach with this business: I’d rather work really hard now, so I can play later.”

Along the way, Kelly and Carrie discovered that this business is about having your life under your control. “It’s not about us and our goals,” says Kelly. “It’s about other people and their goals. As you help other people attain their goals, you’ll naturally achieve the ones you’ve set for yourself, too.”

As for Kelly, he’s a much happier man these days. “I’ve found that practicing law is the exact opposite of the Quixtar opportunity. In law, you win by intimidation. In this business, you win by making friends.”

The original lawsuit was filed on July 28th, 2008 and the plaintiff's filed a First Amend Status Report & Req Special Jury Trial Setting. However, in the middle of all this, Rogers filed bankruptcy on July 27th, 2010 and the entire process was placed on hold with an automatic stay. The bankruptcy judge approved the Kelly G Rogers Chapter 11 reorganization on May 24th, 2010 but Rogers failed to meet the terms of his agreement and the status of the bankruptcy was changed to Chapter 7. Carrie Rogers was not included in the bankruptcy filing.

On September 7th, 2010, the Bank of Texas foreclosed on the Rogers home at 8 Riva Ridge, Frisco, TX and kicked the Rogers out of the home. They now rent a home located right by Rogers old partner, Richard Weyand, in the same Frisco neighborhood as the old home.

After all this turmoil, the Collin County website would indicate these cases have been given the green light to move forward.

Both think they are the "Chosen one"? No. Both think they're the Messiah? No. Both have been indicted by a grand jury? No, not yet. Give up?

The answer, based on the evidence we've managed to accumulate; both share a total disrespect for the rule of law! I think you could call it arrogance.

Arrogance is the attitude that the rules don't apply to you, just everyone else. Arrogant people like Obama and Rogers seem to take advantage of every situation. They know the law, therefore, know where it starts and stops--and know the gray areas. They walk right up to the line, urinate on it and continue right over it because the law only applies to the "Little People" and not to them.

Similar to the Pirates of the Caribbean whereby the "code" was more like a guideline that a hard-fast rule. Same attitude with these two. As a matter of fact, the American people and those who know Kelly G Rogers of Frisco, TX know exactly what I'm talking about. These two will simply not be bothered by these petty rules.

To illustrate the point, just take a look at the attached page outlining the infractions of Kelly G Rogers of Dallas. Located on the Collin County site, this recap is just dandy. Once you enter Kelly Roger and hit enter, an entire page of violations and lawsuits appear. I counted, 20 entries credited to his arrogance. How many do you count? And how many do you have? I'll bet its no where near 20? Why so many? Arrogance.

Go ahead, put the names of some friends in and see if they come up. I entered a few names I know and the most I could find was ONE --and that was another lawyer here in Dallas. But TWENTY?

Total disrespect for the rule of law. And as such, its not hard to understand why so many stood up and cheered when the Rogers lost their home to foreclosure and were forced to move. A small amount of payback for the time being. Happy New Year.

Kelly Rogers' Trial Postponed until April 2011

The jury trial of Kelly G Rogers has been postponed until April 18th, 2011 according to the Collin County website. The pretrial conference is now scheduled to take place on April 13th.

Apparently a pecking order exists within the DA's office of who gets priority to stand trial. The bad guys are bucketed into two groups; those in jail awaiting trial and those out on bail. Unfortunately, Mr. Rogers is not in jail and therefore has been bumped...for now.

According to sources, Kelly G. Rogers is now at the top of the list of those out on bail and stands a 80-90% chance of going to trial on the 13th of April. The prosecutor assigned to the case is Coleman Sylvan graduated in 2001 with a Bachelor of Arts in Political Science from Furman University. He received his law degree from Southern Methodist Dedman School of Law. While attending law school, he volunteered at the Dallas Public Defenders Family Division. He began his career with the Collin County District Attorney's Office in September 2005 as a misdemeanor prosecutor.

To review; Kelly Rogers was indicted, booked and freed on bail over allegation that he misappropriated corporate funds and purchased personal items such as swimming pools and other. Additionally, Rogers has been sued by numerous groups who invested in various schemes he organized, he's been sued by the SEC for violating security and exchange law and has recently filed and was granted bankruptcy protection. Kelly and Carrie Rogers have also been foreclosed upon by the Bank of Texas and are losing their home at 8 Riva Ridge in Frisco, Texas.

Bank forecloses on Kelly and Carrie Rogers

Kelly and Carrie Rogers of 8 Riva Ridge, Frisco, TX has officially been foreclosed upon by the Bank of Texas. On September 7th, 2010 the substitute trustee assigned to the Rogers Bankruptcy, David Garvin, submitted a statement;

"AND, WHEREAS, default has been made in the payment of the Indebtedness and Bank of Texas, N.A., the holder of the Indebtedness, has since the said default demanded and requested the Trustee to sell the Property in accordance with the provisions of the Deed of Trust, for the purpose of paying the Indebtedness".

This action was taken on September 7th, 2010 and the Bank of Texas paid the sum of $1,400,000 to get the house from the Trustee. I would imagine the house will be sold at action. No word yet if the Rogers have moved out or will remain in the property.

So the big question is what's the house worth? According to Zillo, the property at 7 Riva Ridge is estimated to be $1,990,000. So what's this house worth? It's worth what ever someone will pay and not a penny more.

Other news; a meeting of the creditors for the Rogers bankruptcy was held today at 2:00 pm. As reported on September 20th, the decision will be whether they allow Rogers to proceed in Chapter 11, force him into Chapter 7 liquidation or not allow any protection under the bankruptcy protection laws. Big implications. Stay tuned.

Kelly Rogers' not fulfilling his bankruptcy committment

A notice of Chapter 7 Bankruptcy hearing has been scheduled for September 27th, 2010 in the case of Kelly G. Rogers. The notice was sent out by the United States bankruptcy trustee who has filed a motion in the Kelly Rogers' bankruptcy to either dismiss the bankruptcy all together, or convert to liquidation under Chapter 7.

This is significant because the original filing by Kelly G Rogers was Chapter 11 reorganization. It required that Rogers' sell his home by July 30th, 2010 and pay the Bank of Texas their $1,728,278 and the Thompson Creditors $180,000. However, the home at 8 Riva Ridge was taken off the market on June 17th, 2010. Did they give up? Only they know.

Additionally, Rogers listed his monthly income (according to Federal Bankruptcy paperwork) as $23,759 for Kelly G Rogers and $31,750 for Carrie S. Rogers. With a combined monthly income of $55,509, Rogers' has failed to pay fees to the trustee and has failed to file operating reports to the trustee. Therefore, this will be a very interesting proceeding to determine whether Kelly Rogers shall be removed from Bankruptcy protection or if a total liquidation is ordered under Chapter 7.

There is a hearing set for 2 p.m. on September the 27th, 2010 at the following location; 2000 E. Spring Creek Parkway, Plano, TX 75074. The Bankruptcy Trustee is Linda S. Payne will be presiding.

The indictment of Kelly G Rogers was handed down on July 30th, 2009 and the trial was scheduled for July 19, 2010. However, the Collin County website is reporting that the trial is now delayed until November 8th of 2010.

Does this surprise anyone? It shouldn't...let me explain. Kelly Rogers was recently overheard telling a friend at a baseball game that his "Life Long Friend" was about to be elected as the District Attorney's. John Roach had decided to retire and this election is to determine he successor. In checking the election results, Greg Willis handily beat out Jeff Bray to win the primary. Rogers said in no uncertain terms this will finally put an end to this alleged conspiracy that Rogers believes has been launched against him.

It's interesting to point out that Rogers attorney; John C Hardin was a contributor to the Greg Willis campaign. You can see where all this is headed.

So, if this is true, expect more extensions until Greg Willis is elected and sworn in. Rogers can then exercise his influence to get the entire issue dropped. Imagine that....you lost all your money and Kelly Rogers uses this relationship to ensure the long arm of justice will not be served. Would that suck or what?
In the meantime, the July 30th deadline for foreclosure on 8 Riva Ridge in Frisco is fast approaching. Maybe an extension will be as easy as extending his misappropriation of funds indictment with the Collin County DA? The Rogers have now raised the price from $2.2 million to $2.49 million on a home that been on the market for at least 365 days. The next door neighbor’s home at 7 Riva Ridge has been on the market for 505 days and is listed at $2.4 million. Hmmmmmmm.

Judge Approves Kelly G Rogers Bankruptcy

The Honorable Brenda T. Rhoades, United States Bankruptcy Judge, approved the Kelly G Rogers Chapter 11 plan on April 28th, 2010. Download the final order for case 09-42154-BTR-11.

To Summarize

Kelly Rogers has until July 31st, 2010 to sell his home and payoff The BANK OF TEXAS ($1,728,278) and THE THOMPSON CREDITORS ($180,000). If the home does not sell, the Bank of Texas can foreclose on Rogers. Kelly Rogers claims enough equity exists in his home to pay off the Class 3 ($1,908,278) and Class 4 ($105,000) creditors or $2,013,278. In the event the Bank forecloses on Rogers and the subsequent sale does not satisfy the class 3 & 4 claims, they would then be dumped into the "Unsecured Creditor Class 7" and would split a pool of $6,500 per month paid by Rogers over the next 60 months, or $390,000 on a pro-rata basis.

So, let's look at reality. Rogers needs to sell his home for a minimum of $2,013,278 to meet the class 3 & 4 amounts. The home is currently listed at $2,249,999 and it's been on the market for at least 301 days that we know of, since discovered on July 27th, 2009. The home was offered back then for $3,250,000. By the way, how is it that Zillo only shows the home listed for only 59 days? And here's another one; Rogers originally listed his home as 10,675 square feet as compared to the neighbors 12,249. However, the NEW listing says 11,826! Did they recently add another 1,151 feet or just didn't notice it before?

The home at 7 Riva Ridge has been on the market for 486 days and is currently offered at $2,399,900. However, Zillo estimated this property is worth $1,896,500 or 21% lower that the current list price. Obviously, this home is overpriced for the market...based on 486 days on Zillo. At this discount rate, Rogers would need to sell his home for $1,777,499 or 21% lower to move it. As of this writing, we have no way of knowing if a contract is pending but Jan Richey would change the status from "Active" to "Sale Pending" if an offer had been accepted.

Conclusion

Rogers originally filed bankruptcy in July of 2009 and listed his total monthly income as $23,759 per month and $31,750 for Carrie Sewell Rogers. If Rogers loses his home and his $4.6 Million in debt and exchanges it for $390,000, paid over 60 months, thus walking away with a monthly income of $55,509... is that a trade off you'd make? In a New York Second!

Hardly seems fair to those who lost major money in the Rogers/Weyand business schemes. Oh well...on to the indictment for some type of justice.

Kelly Rogers pins hope on Lawyer John C. Hardin

In checking the Collin County website, I noticed that Kelly Rogers will rely on John Charles Hardin as his defense lawyer in his July 19th trial. At issue will be Mr. Rogers indictment concerning the "Misapplication of fiduciary property" amounting to $435,355. The indictment details the transfer of money from Lionheart Energy to his personal account, QBiz, Rio Grande Coal, Pool Environments, Superior Soils, GS Investors, TNT Office Supply and Cash. This is a Felony 1 indictment and Rogers could face jail time.

Rogers is hoping the retirement of John Roach as Collin County District Attorney will put him on the fast track to freedom. It's rumored that Rogers was overheard discussing his indictment and pointed out that a "Lifelong Friend" was about to become the DA and he'll finally be able to put this entire "conspiracy" in the past. In checking the primary election results, one can only assume that "Friend" would be Greg Willis who won the primary handily over Jeff Bray. Even more bothersome is the fact that John Charles Hardin openly endorsed Greg Willis in a published webpage. Given this arrogance towards his past actions, one can only wonder if the criminal justice system in Texas would be so politically driven that it would change direction at a drop of a hat. In this "Culture of Corruption" would an incoming DA overlook the string of lawsuits that outline in detail; the multitude of investments gone bad, the 70 creditors owned $4.6 million, the SEC lawsuit over the Level Par Ponzi scheme, the money removed from businesses and invested for Rogers personal gain, the taking of company funds to purchase a swimming pool...all while he shows not a single shred of remorse towards his "victims" who lost everything?

I challenge the DA's office to complete this trial before the November elections so there is NO CHANCE that justice will not be served. I challenge the DA to push forward, bring all the evidence from the various scams Rogers perpetrated so these investors can finally have the peace of mind. Justice must be served. Put this man in jail, take away his freedom and let him think about what he's done to others while sitting in his orange jump suit. Let him lose his house through the Chapter 7 liquidation he's facing in his bankruptcy proceedings. Many have suffered at his hands and lost everything. Many were forced to filed bankruptcy, lost friendships and lost entire careers due to his actions.

And Rogers attitude towards the entire episode? Screw them, I'm moving on with my life, tuff luck, they approached me, it's a conspiracy.... hey, I'm the victim here?!

Kelly and Carrie Rogers lower sale price for the THIRD TIME!

Kelly and Carrie Rogers have one again lowered the sale price of their 8 Riva Ridge home. Originally offered at $3.2 Million back in December, it was quickly lowered to $2.999 MM, then $2.4 MM and now $2.25 Million. The listing is still being offered by the Jan Richey team.

A quick check on Zillo shows the 11,826 square foot home worth an estimated $805,500. I'm sure it does not take into account the additions. But it's curious that it shows the home sold on 2/7/2008 but does not list the amount. The neighboring home at 7 Riva Ridge is a 12,249 square foot compound that listed at $2,399,999. This home’s been on Zillo for 467 days and shows an estimated value of $1,838,000. In light of the days on the market, it would appear that both homes are grossly overpriced.

The pricing of this home, relative to its valuation and the ensuing lack of sales results are haunting similarity to the outcome most experienced when investing in one of Kelly G Rogers’s opportunities. One distinction this time around; unlike in the past where Rogers was the only one who make money, it appears this time Rogers will join those who ended up losing everything. I'm sure the 70 creditors who are owed $4.6 million in debt will continue to watch this situation, along with his bankruptcy proceedings, very closely.

Rogers handling Bankruptcy clients?

According to this recent document, Kelly G Rogers is now handling bankruptcy filings for individual clients. In a Chapter 7 filing (case number 09-43972) Kelly Rogers submitted a document to keep Marco Frattarelli's case from being dismissed due to a failure to file the required declarations.

According to the document; On January 22nd the court entered its order to dismiss the case for reasons of not following the rules. On January 29th, 2010, the counsel of record files a motion to ask the court to reconsider the order to dismiss the case because the debtor’s council experienced an "Administrative procedural oversight". The possible reasons for this oversight?

First, Kelly G Rogers is in a Bankruptcy battle of his own. To review; Rogers has filed Chapter 11, hoping to reorganize $4.6 Million owed to over 70 creditors vs. having his estate liquidated and paying the money owed. Proceedings should conclude this month. Second, Rogers has been indicted for misappropriation of over $435,000 from Lionheart Energy. His trial date has been set for July 19th, 2010. Third, according to his own bankruptcy filing, Rogers is embroiled in some SIX lawsuits including; DK Joint Venture vs. Richard Weyand, TIFD III-X vs. Richard Weyand, The Stephen and Robin Perry Family Trust vs. Kelly Rogers, Rio Grande Mining LLC vs. Kelly G Rogers, Plains Capital Bank vs. Kelly Rogers and Series C LP vs. Kelly Rogers. Fourth, Rogers is trying to sell his 8 Riva Ridge, Frisco, Texas home. It was this remodeling job that seemed to trigger a variety of issues that could explain this oversight.

It's about time!

On Friday, March 19th, the DA of Collin County finally announced a trial date for Kelly Gordon Rogers, set for July 19th, 2010. This announcement follows a multitude of delays, dating all the way back to October 29th, 2009.

One plausible reason for the delay was to give Mr. Rogers time to return the money. He either chose not to or he couldn’t come up with the money and now time has run out.

The pretrial conference is scheduled for July 14th, 2010. Pretrial conferences are conducted in criminal cases to decide matters that do not inquire into the defendant's guilt or innocence. Under rule 17.1 of the Federal Rules of Criminal Procedure, pretrial conferences for criminal cases may be conducted to promote a fair and expeditious trial. In practice, federal and courts use the pretrial conference in criminal cases to decide such preliminary matters as what evidence will be excluded from trial and what witnesses will be allowed to testify.

At issue will be Mr. Rogers involvement concerning the "Misapplication of fiduciary property" amounting to $435,355. The indictment details the transfer of money from Lionheart Energy to his personal account, QBiz, Rio Grande Coal, Pool Environments, Superior Soils, GS Investors, TNT Office Supply and Cash.

As an interesting side note, TNT Office Supply was sued in December of 2005 and shut down by the SEC in connection with the Travis Correll Ponzie Scheme. Mr. Rogers was invited to participate in the Travis Correll scheme by Harry Robinson "Robbie" Gowdey, a friend. Rogers was the trustee of Gowdey's personal trust and not only participated in the Travis Correll scheme but also solicited others to participate. According to the SEC (Top of page 12). Rogers went on to create Level Par, for which he was sued by the SEC. He eventually signed an agreed final judgment and paid a $150,000 fine.

At this point; “Fair and Expeditious Trail” has a nice ring to it.

This is an excellent question and one that's been discussed often among those who've lost money or been involved with Kelly Rogers. After all, how else can you explain why one person ends up being indicted, sued by multiple investor groups, disliked by so many......all the while claiming that somehow he's a "victim" of a vast right wing conspiracy...a plot of some type.

The short answer to this question can be found on the professional networking site called Linkedin. This is the site used to discover his involvement in the "Takedown Group" and "Land and Minerals Corporation" and a host of other corporation. Recently, we conducted a search for "Kelly Gordon Rogers" and found 4 different profiles. First, Kelly Rogers; President at Land and Mineral Corporation of Dallas, TX. Second, we found Kelly Rogers; Law Terms and Legal Definitions in the Greater New York City Area. Third, we found Kelly G Rogers Kelly Gordon Rogers; Legal definitions in Houston, Texas. Fourth, Kelly Rogers Dallas Kelly Gordon Texas; Lawyer Kelly Rogers in the Greater Los Angeles Area.

Hmmmmmm, Dallas, Houston, New York and Los Angeles? The master of deception?

This information was turned over the General Counsel for Linkedin as a violation of the User Agreement as published by the company. In response; "We have received your inquiry regarding profiles belonging to Kelly Rogers on LinkedIn. We are currently reviewing the profiles in question and will take the appropriate actions upon them. Please note, per privacy reasons, we are unable to disclose further details regarding actions taken upon the accounts”.

Our guess is that these profiles are an attempt to deluge the internet with misleading Kelly G Rogers’s propaganda so the truthful site that discuss his indictment, lawsuits and bankruptcies are hidden to the general public. When attempting to pursuade someone to invest in one of his finanical schemes, the last thing he wants is to have any information about his real life available for all to see.

And as evidence to support these deceptions, Mr. Rogers evoked the cooperation of a convicted felon assigned to harass and intimidate individuals related to cases against Kelly G Rogers. These activities were abruptly halted after phone calls were placed to the Collin County District Attorney's office to report what was happening. No one knows exactly what happened from there but the campaign came to an abrupt halt.

And were happy to report that Linkedin has enforced their user agreements to the extent that the deceptive profile pages have been removed from the site. Chalk one up for the good guys!

On February 2nd, 2009, Michael C. Black working through the lender name of Series C LP, loaned Kelly Gordon Rogers and Carrie Sewell Rogers $125,000. Series C LP is located at 5622 Dyer Street, Suite 200, Dallas, TX 75206. The Rogers promised to pay this debt in regular periodic payments and to pay the debt in full not later than May 1, 2009.

In February of 2009, what was happing in the lives of Kelly and Carrie Rogers? Well, more than a few things were going on but the Rogers' were able to hide these happenings from people like Michael C Black. Let's run down the list and you determine if this track record would justify a loan to Kelly and Carrie Rogers "for work on his homestead, and to pay some bills on which Debtor was behind in making payments". This loan is just so unusual considering this set of events;

Kelly Gordon Rogers describes the action in his bankruptcy filing; “Debtor is being sued by a Plaintiff who loaned Debtor $125,000 for work on his homestead, and to pay some bills on which Debtor was behind in making payments. After the loan was made, Plaintiff demanded that Debtor and Debtors wife execute a Deed of Trust giving Plaintiff a security interest in debtor’s homestead at 8 Riva Ridge in Frisco, TX. Debtor and Debtor’s wife vehemently objected to the request, but finally consented when Plaintiff told Debtor’s wife that he would not try to take her house, and if there were any problems with the loan, she could just call him, and we would all work it out. Three days later Plaintiff called the note in full, and accused Debtor of fraud because Plaintiff discovered that the lien he demanded was invalid as a violation of the Texas HELOC laws. Plaintiff’s admitted violations of the Texas HELOC laws invalidating Plaintiff’s lien, and cause him to lose all of his principal and interest in the Promissory note. So Plaintiff is suing Debtor claiming that Debtor somehow tricked Plaintiff into demanding the HELOC against Debtors objections, because Debtor had practiced law in the past. Plaintiff’s claims have no merit, and Debtors’ affirmative defenses in the case will cause Plaintiff to lose his claim for the $125,000 loan. Debtor also has counterclaims against Plaintiff for slander, breach of contract, tortuous interference with a business relationship, and theft of corporate opportunity, which Debtor has not yet filed in this case. The Plaintiff is suing Debtor for the $125,000 loan, $100,000 for fraud damages, and attorney’s fees and cost of court. The case is still pending”.

Kelly & Carrie Rogers Lower Sale Price of Home

Kelly G Rogers and Carrie S Rogers have lowed the selling price of their home at 8 Riva Ridge in Frisco, Texas. The new selling price is now $2,999,000, reduced from $3,200,000. The listing agent is the "Jan Richey Team".

According to Zillo, this 10,675 square foot home at 8 Riva Ridge has a value range of between $534,750-$727,260, with a current value of $713,000...which seems very low. In comparison, the home at 7 Riva Ridge is a 12,081 square foot home that's been on Zillo for 340 days (which means it's been overpriced and everyone knows it) is valued between $1,168,805 to $1,509,090. It has a current Zillo value of $1,479,500 and is listed at $2,499,900. So it appears in the midst of this economic downturn, the Rogers are in no hurry to sell this home at a listing price of $2,999,000.

Interestingly, this home has been at the epicenter of the problems created for Kelly and Carrie Rogers. You could call it the "Contributing Factor". For example, in the "Thompson " lawsuit, investors claim; ...although it is undisputed that the $180,000 received from the operator was the property of the company, Rogers testified that he "borrowed" the $180,000 for his personal use. According to Rogers, the $180,000 was used for home improvement. To date, Rogers has provided no promissory note or other evidence that he "borrowed" the money. Further, Rogers has so far repaid none of the money.

And in the State of Texas v Kelly Rogers’s indictment, the State identified transfers from the Lionheart Energy LLC checking account; specific monetary transactions described in the indictment for misapplication of fiduciary property as follows;

• Check #992 to Pool Environments on 3/11/2005 = $26,661.00

• Check #998 to Pool Environments on 3/29/2005 = $30,000.00

The Rogers' make the claim that the inability to refinance the $1,200,000 construction loan that matured in February of 2009 resulted in the bankruptcy filing of Kelly G Rogers on July 27th of 2009. However, apparently it didn't wipe out Carrie S Rogers because she was not included in the bankruptcy filing. Yet in the papers filed on 12/4/2009, it states; Unfortunately, the cost of the home exeeded $1,800,000, wiped out all the Rogers' available cash and life savings, caused even more indebtedness, and the home is still not finished. It did say Rogers', didn't it?

In the end, it boiled down to the "Big Dream" home that finally sunk the Amway Dream Machine.

Falcon Ten Energy, LLC and Kelly Gordon Rogers

In an earlier story called; "Thomson Lawsuit Creditors sue Kelly Gordon Rogers: Claims Fraud and Embezzlement", 20 investors filed a motion to have the bankruptcy trustee in Kelly G Rogers’s bankruptcy grant a "2004 examination". The purpose was to help the group
determine the whereabouts of $180,000 of business money that was returned to Kelly Rogers’s personal account.

In terms of this investment, Rogers solicited money to fund a supposed entity called "Falcon Energy, LLC-Buck Hamilton Series" but there is no evidence that the entity was ever created. According to the case; it is presently unclear as to the status or nature of the company. Although Rogers solicited investments in a limited liability company, and Rogers had each of the investors execute both a subscription agreement and an LLC agreement, it is unclear if Rogers actually formed the entity. A review of the Nevada Secretary of State records indicates there is no entity named "Falcon Energy, LLC-Buck Hamilton Series". A review of the Texas Secretary of State records likewise establishes there is no entity with that name. As such, it is unclear as to the exact nature of the relationship between the plantiffs and Rogers. Rogers raised $1,400,000 from Plaintiffs, ostensibly for the purchase of membership interests in the company.

According to the motion; Amazingly, when testifying in response to a 2004 examination request made by this group to the Trustee presiding over Rogers’s bankruptcy, Rogers testified; he did, in fact, "Form a Company" but could not remember where? Rogers further testified that documents reflecting the formation of the company could be found in his prior office space, which has been taken by the landlord. Rogers have since participated in an examination of the records located in Rogers’s prior office space and have yet to locate any records of the company".

Today we came across a Nevada LLC created on March 15th, 2007 called Falcon Ten Energy, LLC. This goes along with the other entity called Falcon Energy, LLC created on March 29th, 2007. We're not sure why these two entities were created but this raises the question; why did Kelly G Rogers create Falcon Ten Energy, LLC and did this corporation receive any of the funds invested in the "Falcon Energy-Buck Hamilton Series" project?

Kelly G Rogers Bankruptcy update IV

Kelly G Rogers filed his Voluntary Chapter 11 case in the United States Bankruptcy Court for the Eastern District of Texas, Sherman Division ("Court") on July 6, 2009, Case No 09-42152. Kelly G Rogers is an individual whose main assets consists of a home, investments and his ability to generate income. Rogers purposes to pay its current indebtedness by restructuring certain indebtedness and by selling his home.

Kelly G Rogers Bankruptcy Original report or Update I, Update II and Update III. and Update IV.

Kelly G Rogers submits this Disclosure Statement pursuant to Section 1125 of the Code to all known Claimants of Kelly Gordon Rogers for the purpose of disclosing that information which the Court has determined is material, important, and necessary for Creditors of Debtor in order to arrive at an intelligent, reasonably informed decision in exercising the right to vote for acceptance or rejection of the Kelly G Rogers Plan of Reorganization dated December 4, 2009 (“Plan”). This Disclosure Statement describes the operations of Kelly Rogers contemplated under the Plan.

Chapter 11 is the principal reorganization chapter of the Code. Pursuant to Chapter 11, Kelly G Rogers is authorized to reorganize its business for its own benefit and that of the creditors and equity interest holders. Formulation of a Plan is the principal purpose of a Chapter 11 reorganization case. A Plan sets forth the means for satisfying claims against and interests in Kelly Rogers. After a Plan has been filed, it must be accepted by holders of claims against, or interests in, Kelly G Rogers. Section 1125 of the Code requires full disclosure before solicitation of acceptances of a Plan. This Disclosure Statement is presented to Claimants to satisfy the requirements of Section 1125 of the Code.

Acceptance of the Plan by the Creditors and Equity Interest Holders is important. In order for the Plan to be accepted by each class of claims, the creditors that hold at least two thirds (2/3) in amount and more than one-half (½) in number of the allowed claims actually voting on the Plan in such class must vote for the Plan and the equity interest holders that hold at least two-thirds (2/3) in amount of the allowed interests actually voting on the Plan in such class must vote for the Plan. Chapter 11 of the Code does not require that each holder of a claim against, or interest in, the Debitor, vote in favor of the Plan in order for it to be confirmed by the Court. The Plan, however, must be accepted by: (i) at least the holder of one (1) class of claims by a majority in number and two-thirds (2/3) in amount of those claims of such class actually voting; or (ii) at least the holders of one (1) class of allowed interests by two-thirds (2/3) in amount of the allowed interests of such class actually voting.

History and Background as told by Rogers

The Chapter 11 Bankruptcy filing of Kelly Rogers was a direct result of his inability to obtain a mortgage for the refinance of a Bank of Texas construction loan that matured on Febuary 1, 2009.

On February 1, 2008 Kelly Rogers obtained a $1,200,000 loan for the construction and renovation of his homestead. The loan was to mature in one year. Rogers’ Builder, Mike Brown of Angel Properties, LLC represented to Rogers that the cost of the home construction and renovation would be $1,200,000, and that it could be completed in one year.

Unfortunately, the cost of the home exceeded $1,800,000, wiped out all of Rogers’ available cash and life savings, caused even more indebtedness, and the home is still not finished. Angel Properties filed a lien against the home despite having abandoned the project, breached its contract, and misappropriated insurance funds due to Rogers. When the Bank of Texas Construction loan matured the bank extended the maturity date, hoping that Rogers would obtain a mortgage. However, when Angel Properties filed a lien against Rogers’ home, no bank would refinance, and Angel Properties refused to release, or even reduce, its’ lien until. Then the Bank of Texas posted the property for a foreclosure sale on July 7, 2009.

Beginning in July, 2006 Mr. Rogers had a falling out with his business partner, Richard Weyand. Rogers believed Weyand had been stealing money from the companies in which they were partners, without Rogers’ knowledge. On a day in July, Weyand coordinated a lock out of Mr. Rogers from his office, and Debtor asserts began a campaign to disparage him to all of the company’s investors, saying that he had embezzled funds. Kelly G Rogers would show that he did not embezzle any funds. Kelly Gordon Rogers believes one of Mr. Weyand’s attorneys, Larry Boyd convinced the District Attorney to indict Mr. Rogers almost five years after the complained of activities. The crush of these criminal allegations has severely hampered Mr. Roger’s ability to obtain work.

At the time of the lock out, Mr. Rogers lost a significant portion of his income. Unfortunately, he had already begun the teardown phase of his home remodeling project, and could not stop the building without suffering the entire loss of the rest of the home. Because he could no longer afford to build the home out of cash flow, he obtained the $1,200,000 loan from Bank of Texas.

An arbitration proceeding ensued between Weyand and Debtor, the cost for these legal proceedings exceeded $120,000 in legal fees, of which Mr. Rogers paid over $50,000. Mr. Rogers asserts there was no evidence presented at the arbitration that he had committed any actual fraud, or embezzled any funds. Rather, the evidence clearly he asserts demonstrated that he paid into the companies over $800,000 of his own money, in excess of the commissions he received for raising the companies start up capital. However, there was some evidence that he participated in handing out the Private Placement Memorandum, which turned out to have incorrect facts stated in it. It was shown that he did not prepare the PPM, nor did he have any knowledge that any of the facts were not completely accurate. All of the Plaintiffs testified that they relied upon Richard Weyand for the information, and they all knew that Mr. Rogers was not the source of the PPM facts. However, the arbitration resulting a finding against the Kelly G Rogers for approximately $715,000 and against Mr. Weyand for more than $14,000,000.

After July, 2006 he obtained employment at Noble Royalties, Inc. as Senior Vice President of Acquisitions, and made approximately $200,000 per year in Salary and benefits. During the time of Rogers’ employment at Noble he also participated as a working interest owner in various oil and gas wells through his company Falcon Energy, LLC. All of the wells that he invested in, and solicited other people to invest with him, turned into dry holes, except the Good 15-1 which was an asset of Falcon Energy, LLC – Buck Hamilton Series.

(Last, Kelly G Rogers makes a bunch of assertions about the Level Par Ponzi Scheme, claiming he was not at fault. However) ...the SEC filed a complaint against him, which he had to settle in order to avoid additional attorneys fees of over $250,000. He had already incurred over $60,000 of attorneys fees, of which he could only pay approximately $35,000. (Kelly G Rogers signed a final judgment with the SEC that states in Case No: 4:07cv246; number 12 on page 5 and 6; Defendant agrees; (i) not to take any action or to make or permit to be made any public statement denying, directly or indirectly, any allegation in the coplaint or creating the impression that the complaint is without factual basis. The statement on page 6 and 7 of this disclosure seem to directly violate the "Agreed Final Judgment" signed by Kelly Rogers).

Post-Petition Operations

Kelly Rogers originally filed this proceeding pro se. After attempting to navigate through the bankruptcy process, the Kelly G Rogers sought and obtained court approval to hire counsel. (Mr. Rogers asked for and received $15,000 to retain a Lawyer. After racking up over $120,000 in law fees and not paying them, I'm sure the only way this current lawyer would take the case is with a retainer paid "Up Front". Also, Kelly Rogers claims on multiple websites to be a lawyer specializing in Bankruptcy. He also has a company called "Takedown Debt Settlement"). Kelly Rogers has received three lawsuits objecting to his obtaining a discharge. Kelly Rogers has also had a motion to dismiss or convert the case to a Chapter 7 proceeding. The Debtor and his counsel have worked rapidly to evaluate Kelly Rogers ability to restructure his indebtedness and repay his creditors.

Lawsuit Creditors

Since the filing of the Kelly Rogers bankruptcy, Kelly G Rogers has had three adversary proceedings commenced against him. Kelly Rogers has agreed to extend the time for another creditor to determine if they wish to proceed.

The Bill Thompson, CR 591, LLC, Darryl J. Tyson, Wayne Johnson, Nick Digiuseppe, Tom Matter, William Noble, Lang Reid, Larry Boerder, Dr. Matt Brown, Glenn Walser, Jarry Kaul, Milly MacDonald, Stuart Reynolds, Jr., James E. Evans, Jr., Harris Block, Territories Unlimited, LLc, Fred Brodsky, Roy S. Washburn, Bill Grant and Michael A. Boch Creditors (“Thomson Lawsuit Creditors”) have filed a lawsuit in the Bankruptcy Court asserting that claims that they are entitled to a constructive trust on the Debtor’s homestead in the amount of $180,000 as well as claims under 11 U.S.C. § 523(a)(2) and (4). The Debtor has denied the allegations.

The Rio Grande Coal Mine LLC dba Mexicaol, LLC, Tom Haas, Christian Litscher, Eric Wade, Kent Loehrke, Raul Sanchez and Peggy Wade (“Rio Grande Lawsuit Creditors”) have asserted claims against the Debtor under 11 U.S.C. § 523(a)(2)and (4) for an undetermined amount arising from a Ponzi run by TNT Office Supply and Travis Correll. The Debtor has denied the allegations.

The DK Joint Venture 1, Dk Joint Venture 2, Vandali LLP, Parlai LLLP and RTB Holdings, Ltd., (“DK Lawsuit Creditors”) assert claims under 11 U.S.C. § 523(a)(2) and (4) arising from an arbitration award. Debtor denies the allegations.

The Steven & Robin Perry Trust, the Hackett Family Trust, the Tendler Family Trust and the J&T Bonutto Revocable Trust (“Trust Lawsuit Creditors”) have not filed a lawsuit in the Bankruptcy against the debtor however, they have requested additional time to do so. The Debtor does not know the specific allegation to be asserted by the Trust Lawsuit Creditors however the Motion on file with the Court asserts that claims under 11 U.S.C. § 523 (a) (2) (4) and (6) might be forthcoming.

Each of these entities will be referenced to as the “Lawsuit Creditors”. The Lawsuit Creditors shall have the option of continuing their litigation against the Debtor, or sharing in the Unsecured Creditors Pool. The Thompson Lawsuit Creditors shall have the option of participating as a class 3 or class 6 creditor, or continuing its lawsuit. In the event the lawsuit creditors desire to continue their litigation, the Debtor shall vigorously defend the lawsuits. Any successful lawsuit creditor shall not be effected by the Plan, and shall be allowed to collect any non-discharged debt from any non estate property. Any lawsuit creditor who elects to participate in the Plan shall agree to dismissal of the pending adversary proceeding or agree not to file suit.

We encourage the creditors to demand Chapter 7 liquidation and force the Riva Ridge home out of homestead and liquidated. This home is the “Crown Jewel” for Kelly Rogers and Carrie Sewell Rogers and would be appropriate payback to all who participation in Kelly G Rogers investment Schemes and were wiped out.

Kelly G Rogers Indictment Update I

To review; Kelly G Rogers of Frisco Texas was indicted by a Collin County Texas Grand jury on July 30th 2009, case number 380-81600-09.. According to the County Clerks site, the offense took place on March 1st, 2005 and is a FELONY 1 charge. The charges include 26990034 Misapp Fiduc/Finan Prop >=$200,000. An arrest warrant was issued, and then executed on August 14th, 2009. Rogers was booked, his mug shot taken and he was incarcerated until a $50,000 bond was posted and he was released.

According to the Clerk’s site, an announcement was scheduled for today, December 3, 2009. However, we learned today that the DA’s office will let that deadline pass, a “131 Passed” and will reschedule the announcement to January 15th, 2009. More time was needed for Kelly Gordon Rogers to get his ducks in a row. Rogers has requested a “Jury Trial” and a trial date should be announced at that time.

Occurring simultaneously to the Indictment, Kelly G Rogers has filed Chapter 11 bankruptcy. A hearing was held on Friday where creditors, who participated in a variety of Kelly G Rogers’s investment schemes, were present. The U.S Trustee is considering a Motion to Dismiss or Convert, or for Alternative Relief. Kelly G Rogers has recently obtained counsel and has filed certain documents in the Case. Counsel for Kelly Rogers represents that a Plan and Disclosure Statement will be filed shortly.

The United States Trustee accordingly requests that the Motion to Dismiss be continued until January 11, 2010 at 2 p.m. Stand by for some additional fireworks as the Trustee considers the plan and “Alternate Relief”. From U.S. Courts.Gov; "Delays in formulating, filing, and obtaining confirmation of a plan often prompt creditors to file motions for relief from stay, to convert the case to chapter 7, or to dismiss the case altogether". Imagine if the U.S. Trustee orders a Chapter 7 liquidation of Kelly G Rogers possessions?

And if a liquidation was so ordered, what would be the actual "Net Worth" of Kelly G Rogers to liquidate? So far; we've seen his July 17th, 2006 balance sheet submitted to banks to "secure lines of credit" for $29,200,400. However, only three years later on July 13th, 2009, Rogers submits his "Summary of Schedules" showing a Negative networth of ($3,184,819). The challenge will be to sort through and seperate facts from fiction to discover the actual number.

The fun is just beginning.

Kelly G Rogers Bankruptcy Update III

A hearing took place on November 20th, 2009 in the bankruptcy proceedings of Kelly Gordon Rogers, Case No. 09-42154. The process involves over 70 creditors who are owed over $4.6 million by Kelly G Rogers. The hearing took place at the United States Department of Justice, Office of the United States Trustee, 300 Plaza Tower, 110 N. College Tyler, Texas 75702 (903) 590-1450.

While Kelly G Rogers has proclaimed himself to be a bankruptcy Lawyer and debt specialist (see Takedown Debt Settlement), he in fact requested, and was granted, the allocation of $15,000 from the Trustee to hire a bankruptcy lawyer to represent him. Having previously stiffed the law firm of Scheef & Stone LLP for $77,934 and Fish & Richardson PC out of $28,264 (see list of unsecured creditors), I’m sure it was cash up front on this deal.

This bankruptcy proceeding basically boils down to this; Kelly and Carrie Sewell Rogers trying to have their debt dismissed while the creditors attempt to hold the Rogers accountable to pay back the debts they incurred. Many of these debts were incurred either by the Rogers obsession to build a 10,000 square foot addition on their Frisco home or costs incurred via the lawsuits and judgments against Rogers as a result of his financial schemes.

A motion was presented to have the hearing continued to January 11, 2010 at 2:00 PM. However, new documents were submitted by Kelly G Rogers outlining his financial situation (see schedule B, Schedule C, Schedule I and Schedule J). We’ve done a quick summary for your review. A few key observations;

1. Stated monthly income dropped from $55,509 to $26,000 or $29,509 drop.

2. Stated monthly expensed dropped from $31,438 to $23,576 or $7,862 drop.

3. Net Income dropped from $24,071 to $2,424 or a drop of $21,647.

4. Total assets dropped from $423,175 to $202,700 or $220,475 less in assets.

5. New asset disclosure of $202,700 falls short compared to the 2007 balance sheet of $693,500. A drop of $507,800!

6. Furs & Jewelry of $6,000 is laughable considering all the reports of the Rogers in St. Thomas purchasing Jewelry.

7. Car disclosures jumped from $8,600 to $51,000. Missed by a little.

So the battle is on and the creditors are formidable and have significant money at steak. Keep an eye on Falcon-Buck Hamilton Series group who invested $1,400,000 in this project. This group seems to be leading the way to not allow these debts to be released but rather, forcing Rogers into a possible liquidation or the judge allowing other actions. . Kelly Gordon Rogers has started a new company called; "Takedown Debt Settlement". This information is recorded with Stacy Kemp, County Clerk of Collin County. We've enclosed two documents to validate the information (simply click on the photo's to enlarge). Kelly G Rogers registered the information with the State on August 14th, 2009. On July 21st, 2009 Kelly Gordon Rogers filed the paperwork to record Takedown,LLC with the Texas Secretary of States office.

According to the website, "Takedown offers an aggressive debt relief option for people who have found themselves in a financial hardship and want to avoid filing bankruptcy. This program only works for people who understand there are very few options left, and are willing to make a commitment to the program. We will work with you to will help determine if debt settlement is a viable option for you. After reviewing your financial situation, analyzing the debts, considering what creditors are involved, we can then formulate a savings time-line and settlement plan, based specifically on your situation".

Recently, after having his law license suspended on 2 different occasions, Kelly Gordon Rogers has been reinstated by the State Bar of Texas. We have contacted the Bar to question this reinstatement.

This story is provided as a warning to anyone who may encounter Kelly G Rogers and his investment schemes to beware of his history. It's ugly, it's extensive and it has financially ruined many.

Kelly G Rogers sued by Wheel Chair companies; Invacare and Bruno

Indicted Attorney, Kelly G Rogers, was sued by two Power Wheel Chair companies in 2005. The suits name Kelly G Rogers; DBA Kabec LLC and Kabec Medical Equipment. Kabac stands for Kelly-Andrea-Ben-Ericka-Carrie Sewell Rogers.

Invacare Corporation and Bruno Independant Living Aids are leading manufacturers of Power Wheelchairs who provide chairs to the most disabled Medicare patents among us. Kelly G Rogers began this medical business to reap the rewards of the huge amounts of reimbursements available from Medicare to those who "Qualify" for a power wheel chair.

Both Invacare and Bruno received judgments totalling $109,959 and $35,472 respectively. These judgments were filed with the State of Texas on May 26th, 2005 on behalf of Invacare and on August 21st, 2006 on behalf of Bruno Independent Living Aids. Apparently, Kelly G Rogers simply forgot to pay these suppliers to the tune of $145,431 from his business operations. I wonder if he ever received Medicare reimbursement for the chairs he took delivery of but never paid?

So the question becomes; did Lawyer Kelly G Rogers ever pay back the $145,431? Yes! We're proud to report that these judgments must have been paid back because a release of Judgment lien was issued on Invacare's behalf on December 31st, 2007 and for Bruno on June 20th, 2007. We've included both the Abstract Judgment for both Invacare Corporation and Bruno, plus the release of judgment lien for both Invacare and Bruno. These are public documents avalable on the Collin County Clerk's website in the "Deeds" section.

But in light of the recent lawsuits in 2008 and 2009, the question now becomes; who's money paid off these liens? Was it the Lion heart investors groups money who won an arbitration award from Kelly Gordon Rogers of over $700,000? Was it the $200,000 the SEC identified that CR Davis transfered to Lawyer Kelly G Rogers personal account? Was it the money Kelly G Rogers removed from the Rio Gande Coal operation and invested in the Travis Correll Ponzi scheme that was paid into his personal account? This group has a pending lawsuit against both Lawyer Kelly Gordon Rogers and Carrie Sewell Rogers claiming fraud and embezzlement. I don't know.

Only a good Attorney will be able to get to the bottom of who's funds were used to payoff these two Power Wheelchair suppliers. One thing is for certain; this will not be the last questionable business operation Lawyer Kelly Gordon Rogers becomes involved within.

Kelly G Rogers issues Cross Claim

In response to a lawsuit heard before the American Arbitration Association, the following information is pulled directly from the Cross-Claim issued by Kelly Rogers, Kelly G Rogers, Kelly Gordon Rogers. In case 71-198-Y-00111-07 and 71-198-Y-00112-7, the AAA eventually issued a judgment against Rogers in the amount of $712,623. See “Investor Group files complaint against discharge ability of $712,000 against Kelly Gordon Rogers; Claims Fraud”.

On February 29th, 2008 Rogers claims against Richard Weyand;

1. Indemnity Claim against the Weyand respondents,
2. Contribution Claim against all Weyand respondents
3. Conversion of Personal property claims against Richard Weyand
4. Fraudulent conversion of business interests against Richard Weyand
5. Libel and Slander against Richard Weyand.

The purpose of this story is to report on number 5; the things Kelly G Rogers claimed Weyand said that was libel and slander. It's interesting how time eventually exposes who's telling the truth.

Rogers begins: Since July, 2006 and continuing until as recently as February 15, 2008, Richard Weyand has repeatedly made material, false statements of fact, both written and oral, about Kelly Rogers to numerous third parties, which, at the time they were made, were know by Richard Weyand to be false. Richard Weyand has made the following false statements about Kelly Rogers since July 2006:

• That Kelly G Rogers embezzled $2,000,000 from companies controlled by Weyand.
• That Kelly G Rogers was in jail.
• That Kelly G Rogers has been indicted.
• That Kelly G Rogers used embezzled money to remodel his house.
• That Kelly G Rogers has $1,000,000 of stolen money buried in his back yard.
• That Kelly G Rogers has $1,000,000 that he is trying to hide in an investment.
• That Kelly G Rogers is trying to hide $1,000,000 in a restaurant investment.
• That Kelly G Rogers is using $1,000,000 cash to build his house.
• That Kelly G Rogers embezzled money and was stealing from Christian Recile.
• That Kelly G Rogers embezzled $200,000 from Level Par Investments, LLC.
• That Kelly G Rogers habitually lied to investors.
• That Kelly G Rogers committed crimes against the State of Texas.

The above statements are all completely false and Richard Weyand knew that they were false when he made each statement. Upon information and belief, Richard Weyand made each of the above false statements to cause injury and damage to Kelly Rogers. One or more of the statements were made to good friends, neighbors, colleagues, associates, investors and/or acquaintances of Kelly G Rogers including; Jay Allison, Roland Burns, Kimball Norman, Todd Wagner, Fred Swell, Carrie Sewell Rogers, Neil Brown, John Miglautsch, Joel Moore, Tim Wijt, Robbie Gowdey, Roland Hughes and many others. AS a direct and proximate cause of Richard Weyand’s intentional communication of false and misleading statements of material facts to the above personas, and others, Kelly Rogers’s reputation has been severely damaged.

This Corss-Claim was issued on February 29th, 2008. As of November 2nd, 2009 a little bit of time has passed and now it sheds some interesting light on SEVEN of the ELEVEN charges;

• That Kelly G Rogers was in jail. Kelly Gordon Rogers was in fact indicted on July 30th, 2009, mug shot taken, briefly jailed and now is out on bond. Rogers has requested a jury trial but was in fact in jail.
• That Kelly G Rogers has been indicted: In fact, he was on indiced on July 30th, 2009.
• That Kelly G Rogers used embezzled money to remodel his house: In fact, Rogers has been sued by several investor groups for fraud and embezzlement. Most state that money was used to remodel his home. Specifically; Bill Thompson, CR591, LLC et al v. Kelly Gordon Rogers, Rio Grande Coal Mine, Investor group asks judge to not discharge $712,000 claiming fraud. In one claim, Falcon Energy, LLC-Buck Hamilton Series, investors claim that Rogers took $180,000 and applied it to remodel his home!
• That Kelly G Rogers is using $1,000,000 cash to build his house: Rogers did borrow $1,232,000 from the Bank of Texas. Right amount but not cash.
• That Kelly G Rogers embezzled money and was stealing from Christian Recile: Rogers has been named in several lawsuits against him for Fraud and Embezzlement.
• That Kelly G Rogers embezzled $200,000 from Level Par Investments, LLC: This transaction was documented in Securities and Exchange Commission vs. Global Finance & Investments, Inc Case No; 4:07cv346. Item 55 on page 13 of the SECURITIES AND EXCHANGE COMMISSION, vs. GLOBAL FINANCE & INVESTMENTS, INC.
• That Kelly G Rogers habitually lied to investors: I’ll let the investors make comments on that one. In fact, Rogers was informed about the SEC investigation into Level Par during the first week of July, 2006 yet the truth was not told to investors until August of 2006. Is that lying? Read the letter yourself.
• That Kelly G Rogers committed crimes against the State of Texas according to the Indictment issued this summer: State of Texas vs. Kelly Rogers/ Case 380-81600-09. What do you think?

Finally, several names have been mentioned “as good friends, neighbors, colleagues, associates, investors and/or acquaintances” which Weyand “cause injury and damage to Kelly G Rogers”. Did anyone except Kelly Rogers cause injury and damage to his own name? In his own words....audio.

The best example is how Rogers has stiffed the very lawyers who wrote up this Cross Claim! He stiffed Scheef & Stone LLP who are listed as a creditor on the bankruptcy filing for $77,934.46. Additionally, Rogers stiffed Fish & Richardson PC for another $28,263.88.

That’s $106,198 dollars worth of damage and illistrates why we created this blog; to protect the public from these financial schemes.

Kelly G Rogers attempts to sell another scheme

Another investment scam has been uncovered. We bring this information to the general public as a warning that Kelly G Rogers has learned nothing by the civil and criminal suits he's faced since his the Lionheart Oil and Gas debacle back in 2006. This latest example illustrates perfectly why this website has been established.

According to the Joint Venture Agreement dated March 27th, 2009, the scheme purported to allow Kelly G Rogers to market a "Digital Business Card" and have an exclusive in the MLM and Network Marketing industry. A list of 72 MLM clients are listed in the attached Joint Venture Agreement. The agreement would assign "Potential Commissions and Profits" to the investor in exchange for investment increments of $50.000. According to the JV agreement; "Rogers has acquired the exclusive rights to market the JumpLab Digital Business Card to any and all Multilevel Marketing Organizations listed on Exhibit A. Rogers hereby agrees to assign $250,000 of the potential commissions and profits received from those interests to (name) for every $50,000 contributed to the Joint Venture by (name), up to, but not more than, $150,000 for and assignment of $750,000 of commissions and profits from the sale of JumpLabs cards".

It's all appears to be very slick and Kelly G Rogers-esk but it's simply more of the Lawyers Kelly Gordon Rogers whiffle-dust that has become his trademark. As a review of the facts; Both Carrie Sewell Rogers and Lawyer Kelly G Rogers are being sued by seven investors for the Rio Grande Coal mine operation for fraud and embezzlement, 5 investors are suing the Rogers bankruptcy to keep the court from discharging $712,000 awarded by an arbitration panel, another 20 investors are suing him over the "Falcon Energy-Buck Hamilton Series" oil & gas deal gone bad, the District Attorney has indicted Rogers on July 30th of 2009, the SEC sued and Rogers agreed to an AGREED FINAL JUDGMENT and Rogers filed bankruptcy on July 27th of 2009. In total, Rogers listed 6 separate lawsuits in his bankruptcy filing.

Three interesting observations about this JV Agreement.

First, while Lawyer Kelly G Rogers makes the claim that Kelly G Rogers has "acquired the exclusive rights to market the JumpLab Digital Business Card to ANY AND ALL MULTILEVEL MARKETING ORGANIZATIONS LISTED ON EXHIBIT A, a closer look at Exhibit A shows at least 6 that are "Taken" or the comment "Hmmmm".
Second, this JV Agreement is written on March 27th, 2009. Rogers filed bankruptcy in July 27th of 2009 just days before he was indicted. If an investor had given money to the Rogers Family LP, would they have ended up as an "Unsecured Non-Priority Creditor" on Kelly Rogers bankruptcy filing only 4 months later?
Third, who borrows money to begin a sales organization anyways? Earning commissions is risky at best. Who knows if clients will even purchase your product? Is it priced right, does a need exist? This is the equivalent of loaning someone money to invest in the stock market.

Last. We spoke to a representative from JumpLabs and they said they'd broken off discussions with Lawyer Kelly G Rogers. They stated he should not be representing the company and if we heard he was, they instructed us to call them immediately. So, if the investor had invested in this project and JumpLabs had broken off the agreement, would Kelly G Rogers refund the investors money?

All good reasons to stay away from this financial predator at all costs.

Kelly G Rogers sued by the SEC in 2007

On July 18th, 2007, the Securities and Exchange Commission filed the lawsuit; Securities and Exchange Commission vs. Global Finance & Investments, Inc Case No; 4:07cv346. This lawsuit specifically named Kelly G Rogers as a Plaintiff.

The United States Securities and Exchange Commission (“Commission”) files this Complaint against Defendants Global Finance & Investments, Inc.; Charles R. Davis, William F. Dippolito; Lucre Fund, LLC, JTA Enterprises, Inc.; William H. Clark; Level Par Investments, LLC; Kelly G. Rogers; Sterling Meridian, LLC; Ronald J. Linn; and Glenn Maske.

Kelly G Rogers involvement had been discovered by the SEC while they conducted an investigating into the "Travis Correll" Ponzi Scheme. The SEC shut down this operation in December of 2005. During the SEC research, they came across a deposit into CR Davis's account in the name of Level Par. This caused the SEC to reach out and investigate Level Par. This contact by the SEC resulted in the following letter being sent out to all 35 Level Par Investors in August of 2006. Seems that Kelly Rogers was an active participated in the Travis Correll Ponzi scheme. In Rio Grande Mining vs. Kelly Rogers and Carrie Rogers, Plaintiffs claim that Rogers embezzled company funds and invested in the Correll scheme, having the profits paid to his personal account.

According to the complaint; Rogers’s fraudulent offering;

In January 2006, Clark told Kelly G Rogers that Clark had invested with Global Finance and was receiving profits from Global Finance’s program. In fact, drawing from the representation in Davis’s December 20, 2005 joint venture amendment, Clark represented to Rogers that he had $100 Million invested in the Global Finance investment program.

In February 2006, after Kelly G Rogers expressed an interest in participating in Global Finance’s program, Clark introduced Rogers to Davis. According to Rogers, Davis offered him a “totally secure” high-yield program involving the purchase and sale of bank debentures that paid monthly returns of up to 25 percent. Davis touted the fact that the funds would be safely deposited in an attorney’s trust account and would not be withdrawn until an actual transaction commenced or instrument was purchased.

In February 2006, Rogers was the managing member of Level Par and its sole contact with Global Finance. Rogers, using Level Par as a pooling vehicle, conducted an offering, and invested the proceeds with Global Finance. Based on Davis’s representations, Rogers prepared Level Par’s offering documents, promising investors monthly returns ranging from 3 to 10 percent. Rogers orally represented to Level Par investors that their principle was not at risk because it remained in an attorney’s trust account. In many cases, Lawyer Kelly G Rogers personally guaranteed funds invested by those in his Networking business, many who were sucked into his deals based on the relationship developed via the “Business”. Rogers also told investors that the funds would be used as collateral to trade in various bank debentures or mortgage backed securities. Rogers told one investor that “the World Bank would have to collapse to lose his investment”. Rogers raised $4.7 Million from approximately 35 investors and wire transferred all of it to Global Finance in February or March of 2006.

Rogers knew that Davis’s claims were fraudulent. First, Rogers was an investor in Correll’sheme, a similar high-yield investment program, which had ceased making promised payments. Also, Rogers was on notice that these investments were scams when he learned of the Commission’s allegations in the Correll civil action in which Robbie Gowdey, Kelly G Rogers’s friend and neighbor, was charged with violation of the federal securities law. To illustrate the friendship, Rogers had been assigned as the trustee to Robbie Gowdey’s family Trust account. Robbie Gowdey passed away on January 8, 2009.

On July 13, 2006, Global Finance notified Level Par that it had terminated their agreement and identified $775,000 in previous payments. When Level Par’s other members received Global Finance’s notification, they realized that Rogers had misappropriated $200,000 belonging to their investors and removed Rogers from Level Par.

Claims Against : Kelly Gordon Rogers

1. Violations of Sections 10(b) of the Exchange Act and Rule 10b-5.

2. Violations of Sections 17(a) of the Securities Act.

3. Violations of Sections 5(a) and 5(c) of the Securities Act.

4. Permanently enjoins Kelly Rogers from future violations of 5(a), 5(c) and 17(a) of the securities act.

AGREED FINAL JUDGMENT AS TO DEFENDANT KELLY G. ROGERS

On April 9, 2007 agrees to a “Consent of Defendant Kelly G. Rogers”.

1. Defendant Kelly G. Rogers waives services of Summons and the Complaint in this action, enters a general appearance, and admits the Court’s jurisdiction over Defendant and over the subject matter of this action.

2. Without admitting or denying the allegations of the complaint(except as to personal and subject matter jurisdiction, which Defendant admits), Defendant hereby consents to the entry of the Agreed Final Judgment as to Kelly G. Rogers in the form attached hereto and incorporated by reference herein, which, among other things;

• Permanently restrains and enjoins Defendant from violations of Section 5(a), 5(c) and 17(a) of the Securities Act of 1933 and Sections 10(b) of the Securities Exchange Act of 1934 and Rule 10b-5 promulgated there under;

• Orders Defendant to pay disgorgement in the amount of $100,000, plus prejudgment interest thereon in the amount of $3,360; and

• Orders Defendant to pay a civil penalty in the amount of $50,000 under Sections 20(d) of the Securities Act and Sections 21(d) of the Exchange Act.

The question now becomes; did Rogers knowingly violate the terms and conditions set forth by the SEC on April 9th, 2007 when he sold the deal called Falcon Energy, LLC- -Buck Hamilton Series" or any other of these schemes that took place at or around April of 2007?

These and many more questions will be answered in the weeks and months ahead as the lawsuits begin to play out in courts. As of today, Level Par investors are still waiting for the return of their funds. In 2007, the SEC turned over $7.2 Million recovered from the Global Finance scheme and assigned Hays Financial Consulting to handle the trust. Keep in mind; while these investments were made in 2006, the final distribution has still not been made in October of 2009. Many families have been financially devastated by the schemes that were solicited for by Kelly Rogers.

Rio Grande Investors Sue Kelly G Rogers & Carrie Sewell Rogers; Claims Fraud and Embezzlement

The Rio Grande Coal Mine group has issued a complaint; To Determine Discharge ability of Debt owed to the investor group. Seven investors filed the complaint to the United States Bankruptcy Court of Eastern Texas on October 1, 2009 against bankrurptcy case No 09-42154. The group is asking the Trustees not to dismiss the debt owed to these investors as a result of an investment solicited by Lawyer Kelly G Rogers. In the statement of facts, we quote the following information directly from the lawsuit; Kelly G Rogers solicited the Plaintiff's to make an investment in Rio Grande. The solicitation occurred using wire communications in interstate commerce. Kelly G Rogers is not licensed under state or federal law to solicit investments and securities. This is a very interesting statement considering that Lawyer Kelly Gordon Rogers has been sued by the SEC and permanently restrained and enjoins Rogers from a violating variety sections in the Security act of 1933. So it makes one wonder if Lawyer Kelly G Rogers has violated the consent of this final agreement? Read the SEC Consent of Defendant Kelly G Rogers for yourself.

To continue; the solicitation made by Kelly G Rogers is a security as defined under federal law. Kelly G Rogers misrepresented the investment in Rio Grande to the plaintiffs. After receiving the investments funds from the Plaintiffs, Kelly G Rogers misappropriated and otherwise embezzled the investments made in Rio Grande by the Plaintiffs. It goes on; Kelly G Rogers used the Plaintiffs investment funds from Rio Grande bank account to participate personally in a Ponzi scheme associated with TNT Office Supply and Travis Correll. Kelly G Rogers misappropriated and embezzled Rio Grand funds from the Rio Grande bank account in order to personally participate in the Travis Correll Ponzi scheme. The Travis Correll Ponzi scheme paid money back to Kelly G Rogers and Carrie Rogers. Carrie (Sewell) Rogers participated in spending the payments received from the Ponzi scheme and making deposits of the payments from the Ponzi scheme. The payments from the Ponzi scheme were deposited into a joint bank account in the name of Kelly G Rogers and Carrie (Sewell) Rogers. Kelly G Rogers and Carrie Sewell Rogers jointly received substantial sums of money in the payback scheme from the Travis Correll Ponzi scheme. Kelly G Rogers and Carrie Sewell Rogers did not pay the money back to Rio Grande or to Rio Grande's investors, the Plaintiffs.

The Securities and Exchange Commission conducted an investigation of the Travis Correll Ponzi scheme and uncovered wire transfers authorized by Kelly G Rogers transferring money from the Rio Grande bank account in Collin County, Texas to a bank account in the name TNT office-supply. These wire transfers by Kelly G Rogers were not authorized by Plaintiffs and were not a lawful use of the funds and money belonging to Rio Grande. Kelly G Rogers never disclosed to the Plaintiffs that he was using their investment money to participate personally in a Ponzi scheme, and Plaintiffs never authorized Kelly G Rogers to use their money and their investment in Rio Grande to personally participate in the Travis Correll Ponzi scheme.

Kelly G Rogers owed Plaintiffs a fiduciary duty. Kelly G Rogers breached his fiduciary duty. Kelly G Rogers embezzled, converted and misappropriated money and funds invested by Plaintiffs in Rio Grande for his personal benefit and for the benefit of Carrie Sewell Rogers. Carrie Sewell Rogers knowingly spent money from the joint bank account controlled by her and her husband, Kelly G Rogers, which was money deposited from the Travis Correll Ponzi payments. Carrie Sewell Rogers endorsed checks from the Travis Correll Ponzi payments and deposited those checks in a bank account in Collin County, Texas that she had joint control over with her husband, Kelly G Rogers. Kelly G Rogers and Carrie Sewell Rogers engaged in a joint enterprise and civil conspiracy to defraud Plaintiffs of their investment in Rio Grande by taking money from Rio Grande, participating in the Travis Correll Ponzi scheme, and then depositing Ponzi payments from the Travis Correll Ponzi scheme in their joint bank account which both Kelly G Rogers and Carrie Sewell Rogers had access to.

Additionally, Kelly G Rogers and Carrie Sewell Rogers sold equipment belonging to Rio Grande. Kelly G Rogers and Carrie Sewell Rogers retained the proceeds from the sale for their personal benefit and have failed and refused and continue to fail and refuse to pay the proceeds from the sale of that equipment to Plaintiffs. Kelly Gordon Rogers and Carrie Sewell Rogers used the proceeds from the sale of the equipment for their personal benefit. The equipment was owned by Rio Grande and was purchased with investment funds from the Plaintiffs.

The lawsuit summarizes the following counts; ONE-FRAUD: Kelly G Rogers and Carrie S Rogers made the misrepresentations of fact noted above with knowledge of their falsity, with the intent of defraud Plaintiffs, who justifiable relied upon those misrepresentations and were damaged by Rogers’s fraud. TWO-FRAUD WHILE ACTING IN A FIDUCIARY CAPACITY: Kelly Rogers was in a fiduciary relationship with Plaintiffs. Kelly Rogers committed the fraud noted above and made the material misrepresentations of fact with knowledge of their falsity and with the intent to defraud Plaintiffs who justifiably relied upon those misrepresentations and were damaged. THREE-EMBEZZLEMENT: Kelly G Rogers and Carrie Rogers embezzled money from Plaintiffs. FOUR-NONDEBTOR SPOUCE: Carrie Rogers as a non-debtor spouse is a party so that the Court may determine the dischargebility of the debt pursuant to 11USCA 524(b)(2). FIVE-DAMAGES: The damages suffered by Plaintiffs are in excess of the minimum jurisdictional limits of the court. Debtor is also liable for punitive damages in an amount to be determined by the court.

The group is simply asking the court to disallow the automatic stay against the lawsuit that would essentially release Kelly Gordon Rogers and Carrie Sewell Rogers from any responsibility for their actions. More to come as information becomes public.

DK Lawsuit Creditors file complaint against Kelly Gordon Rogers; Claims Fraud

Another group of investors filed a complaint to the United States Bankruptcy Court for the Eastern District of Texas-Sherman Division. Under Case No 09-42154-BTR-11, 5 entities have appealed to the court to not allow the release of this debt assigned to Lawyer Kelly G Rogers;

Following a three week arbitration hearing in May and June of 2008, the arbitration panel issued its award in the Arbitration proceeding dated April 1, 2009. The Award issued damages to these investors as a result of investing in this oil and gas entity. This group was created by several individuals, including Lawyer Kelly G Rogers. The entity was officially issued by the Recorder of Collin County on March 1st, 2005. The paperwork was submitted by Lawyer Kelly G Rogers and is posted below.

The complaint, objecting to the discharge of awards issued against Lawyer Kelly G Rogers, included all but one investment group. That group is KCR Investments, Inc which is short for "Kelly and Carrie Rogers Investments, Inc. This group represented money invested by Carrie Rogers Father, Frederic D. Sewell. Mr. Sewell is one of the founders of Netherland, Sewell & Associates, Inc. According to the site; NSAI was built on the vision and integrity of Clarence Netherland and Fred Sewell. Over 45 years later, our commitment remains the same.

Many of those who invested in these oil and gas offerings will tell you that Rogers often dropped his father-in-laws name as an investor. This was used in the context that he was giving it his stamp of approval, even though it was emphasized that we were not suppose to know this information.

Turning to the documnet, here are the counts; One-Rogers obtained money and/or property from Plaintiffs by false pretenses, by false misrepresentations, and/or by actual fraud. Two-that the debts owed by Rogers are for fraud and/or defalcation while acting in a fiduciary capacity. Finally-the arbitration panel, in the Award, specifically found Rogers liable to Plaintiffs for, inter alia, fraud and breach of fiduciary duty.

If you're keeping score at home, two groups have now asked the court to suspend the release of funds owed to them by Lawyer Kelly G Rogers. One group (Falcon Energy, LLC-Buck Hamilton Series) invested $1,400,000 and is asking the judge to preserve the $180,000 that was embezzled by Lawyer Kelly G Rogers and be assigned as a lien against the Rogers home. You may know that in Texas, your home is protected under the Homested Act. As a result, Lawyer Kelly G Rogers tried to cram as much money into this home in order to preserve his wealth from investors who have sued him. However, the first group is asking the judge to include thier $180,000 that they claim Rogers embezzled, to be applied against the home.

The second group (dicussed here on this page) have asked the judge to disallow the release of $712,623 in debt as part of a $14,341,333 total award issued as a result of the Lionheart oil and gas debacle. To our knowledge, no ruling has been issued to date.

Thomson Lawsuit Creditors sue Kelly Gordon Rogers: Claims Fraud and Embezzlement

Kelly Gordon Rogers is named as the defendant in another lawsuit filed on October 2nd, 2009. Bill Thompson, CR591, LLC et al v. Kelly Gordon Rogers, alleges Fraud and Embezzlement against Rogers and was filed in the United States Bankruptcy Court for the Eastern District of Texas, Plano Division. The purpose of this suit is to arrest control of these assets from Debtor and place in the hands of Plaintiffs, who provided all of the funding for the purchase of these assets.

This lawsuit involves 20 of the 22 known members of the Company consisting of approximately 95% of the preferred member’s interest. In 2007, Rogers was searching for investors for this scheme. The stated purpose of this company was to purchase mineral interests and develop oil and gas wells. At the time Rogers solicited the investors, the company owned one producing oil well, and Rogers sought sufficient funds to enable the company to "Turn Key" two gas wells and to begin drilling a third gas well, according to the lawsuit. Based a powerpoint developed by Rogers and other information, the members invested $1,400,000 with self proclaimed Laywer Kelly Gordon Rogers.

The suit claims that Lawyer Kelly G Rogers embezzled company assets while acting as managing members. According to the suit, Rogers declared the first gas well a mechanical failure and had it plugged. The second gas well also purportedly suffered from mechanical failures and was terminated. It is unknown at this time if any work at all was done on these wells or what the funds for these wells were used for. In October, 2008, work on a purported third gas well was stopped and the gas well operators transferred to Rogers the sum of $180,000. These funds were previously paid by the company to the operators to develop a third gas well and the operators' payment to Rogers was a return of the unused portion of the prepaid drilling costs for the third gas well.

It goes on; although it is undisputed that the $180,000 received from the operator was the property of the company, Rogers testified that he "borrowed" the $180,000 for his personal use. According to Rogers, the $180,000 was used for home improvement. To date, Rogers has provided no promissory note or other evidence that he "borrowed" the money. Further, Rogers has so far repaid none of the money.

According to records from the Nevada Secretary of State, Lawyer Kelly G Rogers created an entity named Falcon Energy, LLC on March 29th, 2007. The status of this corporation was "Revoked" as of April 1, 2009. This is not unusual for Lawyer Kelly Gordon Rogers. Rogers has demonstrated a clear pattern of poor standing within organizations since 2002. A check of his law license shows he was suspended (Since this story broke, Kelly G Rogers has updated his law liscence. However, the Texas State Bar is looking into the case) by the Supreme Court of Texas in both 2002 and 2008. And now this entity is officially "Revoked" by the State of Nevada because the Rogers apparently didn't pay the $125.00 fee due to the state.

In terms of this investment, Rogers solicited money to fund a supposed entity called "Falcon Energy, LLC-Buck Hamilton Series" but there is no evidence that the entity was ever created. According to the case; it is presently unclear as to the status or nature of the company. Although Rogers solicited investments in a limited liability company, and Rogers had each of the investors execute both a subscription agreement and an LLC agreement, it is unclear if Rogers actually formed the entity. A review of the Nevada Secretary of State records indicates there is no entity named "Falcon Energy, LLC-Buck Hamilton Series". A review of the Texas Secretary of State records likewise establishes there is no entity with that name. As such, it is unclear as to the exact nature of the relationship between the platiffs and Rogers. Rogers raised $1,400,000 from Plaintiffs, ostensibly for the purchase of membership interests in the company.

Amazingly, when testifying in response to a 2004 examination request made by this group to the Trustee presiding over Rogers’s bankruptcy, Rogers testified; he did, in fact, "Form a Company" but could not remember where? Rogers further testified that documents reflecting the formation of the company could be found in his prior office space, which has been taken by the landlord. Rogers have since participated in an examination of the records located in Rogers’s prior office space and have yet to locate any records of the company. It maybe that the members of the company are simply members of an unincorporated joint stock association, a general partnership, or a trust. In any event, the company has significant assets which are under the direct control of Rogers. The purpose of this suit is to arrest control of these assets from Rogers and place it in the hands of the Plantiff, who provided all of the funding for the purchase of these assets.

09-42154-11. This trust invested $420,000 in the "Buck Hamilton Project". Based on the quote listed in the preceeding paragraph, the 2004 Examination request must have been granted since Rogers testified that he did form a company but couldn't remember where. To quote the motion; It is well settled that the scope of examination allowed under Rule 2004 is broader than discovery allowed under Federal Rules of Civil Procedure and may be in teh nature of a "Fishing Expedition". It is well established that the scope of a Rule 2004 examination is extreamely broad and...allowed for the 'purpose of discoverign assets and unearthing frauds' and has been compared to a 'fishing expidition'.

The suit claims the following.

• First, Rogers is indebted to the company in the sum of at least $180,000 on a debt for fraud or defalcation while acting in a fiduciary capacity, embezzlement, or larceny.

• Second, Rogers is indebted to the company in the amount of any company funds used for purposes other than in compliance of the LLC Agreement or the Subscription Agreement for false pretenses, false representations, or actual fraud.

• Third, Plaintiffs request the Court declare Rogers home be subject to a constructive trust in favor of the Plaintiffs for the amount of $180,000. The basis of this request is that; (a) Rogers committed actual fraud or has committed constructive fraud through the breach of a preexisting fiduciary or confidential relationship (b) Rogers would be unjustly enriched by retaining the proceeds of the wrong and (c) there is a traceable res upon which to impress the trust.

• Fourth, Plaintiffs request the Court to enter an order requiring Rogers to render a forensic audit of all transactions engaged in by Rogers.

In 2006, Kelly Rogers was sued by the SEC for his involvement as a facilitator in a ponzi scheme. The original complaint was filed on July 18th, 2007, Case 4:07cv346. Eventually, Rogers agreed to a final judgment contained in Doc 7-2, signed by Rogers. In the agreement, Rogers agrees to a variety of rules and restraints.

The ramifications of the; Bill Thompson, CR591, LLC et al v. Kelly Gordon Rogers are very important since it expose specifics of how Rogers sold securities to these investors. These details will be instrumental in answering the question; did Rogers violate his settlement with the SEC? Further, will any of these allegations assist the Collin County DA win a conviction on their indictment of Kelly Rogers? And did Rogers violate any FINRA rules when raising these funds for Falcon Energy, LLC-Buck Hamilton Series deal? For those who don't know, FINRA exists to for investor protections. They work hand in hand with the SEC. On you review their website, the headline reads; "Investor Protection, Market Interity". If you look at the SEC Case 4:07cv346 against Kelly Rogers, Marshall Gandy was the lead attorney for the SEC. If you review Marshall Gandy's new Lindedin profile, he is now Senior Regional Counsel at FINRA.

Kelly G Rogers files Bankruptcy Part II

Kelly G Rogers Bankruptcy filing (Part I) was not surprise to those who know his mode of operation. It also came as no surprise that his wife, Carrie Rogers, was excluded from the Chapter 11 filing. By the way, click on any of these documents to see them in full size.

Interesting. So the purpose of this Bankruptcy follow up story is to;

1. Raise inconsistencies discovered while comparing Mr. Rogers “summary of schedules” from his bankruptcy filing against the Personal Balance sheet provided to bankers in order to secure financing.

2. Identify specific assets that have totally disappeared or are significantly understated on the new summary.

3. Question how Kelly Rogers can lose millions of dollars of friends, business associates and Investors money, rack up massive debt, then create a cleaver strategy to free him of all responsibilities and simply live happily ever after on Carrie Rogers stated income of $45,000.

As we explore this information, I wonder how the people from Series C LP feel today about loaning both Kelly and Carrie Rogers $125,000 on February 2nd, 2009? Afterall, Kelly and Carrie Rogers signed their good name on the bottom line, promising to pay the $125,000 back on May 1st, 2009. It makes me wonder who owns this Series C LP company and why they didn't know the track record of lawsuits and investigations surrounding Kelly G Rogers when they loaned him the money back in February? Couldn't they have Googled his name and seen the lawsuit issued by the SEC? I wonder how they felt on July 9th when Kelly filed Chapter 11? Do you think they now question whether they should have made that loan for $125,000? I'll bet they were very surprised when the bankruptcy papers showed up at their office shortly after the filing! Maybe if this blog had been up and running back in February, they could have saved themselves some hardship at the hands of Kelly and Carrie Rogers? Thus, the purpose of this truth.

Moving on, let's review some facts. In case number 71-198-Y-0001-07 and 71-198-Y-0001-08, Kelly Rogers’s “First Amended Cross-Claim against Co-Respondents, Page 3: “Since July, 2006 Richard Weyand has methodically committed acts of fraud against Kelly Rogers by illegally taking from Kelly Rogers his rightfully owned interests in many businesses. In July, 2006 Kelly Rogers and Defendant Weyand were partners in no fewer than 15 entities that were partnerships, LLC’s, corporations or Joint Ventures. Kelly Rogers obtained his ownership in these entities through either payment from his personal funds, interests derived from founding the companies and assisting in building the companies, providing his personal financial statement and personally guaranteeing the debts of the companies, and providing services And equipment to the certain companies”. So we can clearly establish that the purpose of the July 17th, 2006 balance sheet was to provide information to “Personally guarantee debts of the companies”. So let’s compare the this balance sheet and the stated assets listed on July 17th, 2006 to the assets listed on the chapter 11 filings in case number 09-42154.

First, let’s do some quick clean up on the bankruptcy filing. On the Summary of Schedules, Mr. Rogers has incorrectly added his numbers. He has understated the amount owed to unsecured creditors by $104,997. He stated a total of $4,300,863 to unsecured, non-priority creditors. So, if you’re keeping score at home, the total owed should read $6,563,852 rather than $6,458,794.

To me, this is shocking. It begs the question; which set of numbers are correct, the numbers presented to banks from his July 17th, 2006 balance sheet when he was personally guarantee debt or the numbers in his bankruptcy report? On the other side of the coin, did the value of these assets drop form $26,408,500 to $58,600 or have they been transferred out of him name into third party and sheltered from bankruptcy? Our guess is this did not happen because on Exhibit D of the filing it specifically asks if any property has been transferred in the last two years and the answer is “None”.

However, one investor group who plunked down $1,200,000 for a Falcon Energy deal has filed a “Motion for rule 2004 Examination of Kelly Gordon Rogers”. Under this motion, it would allow the investors to dig through the assets of Rogers to find where the heck their money went. “Prior to the petition date, and upon information and belief, the debtor obtained possession of assets of the trust and currently has knowledge of where the trust assets or proceeds thereof are located”. This "deal" occurred in February of 2007 when Mr. Rogers was establishing his “Falcon Energy LLC” empire.

So, is it possible for one individual; to lose millions of dollars of other peoples money, add an 8,000 square foot addition to their home, place the home in a trust, rack up $6.5 million in debt, file Chapter 11 to release the debt to creditors, then walk away to live on his wife’s $45,000 per month income? Is that possible? Only time will tell.

In the meantime, the answers to these and other questions can only be determined by the Trustee who will sort through the maze of information. In the end, the truth will be uncovered.

Kelly G Rogers Suspended as an Attorney in Texas

Kelly G Rogers of Frisco Texas has identified himself as a lawyer for many years. A graduate of Southern Methodist University, Mr. Rogers earned his law degree in 1986, according to an Avvo account set up by Mr. Rogers. However, if you click on the "LICENSES" section of the Avvo website, specifically "SEE LICENSE DETAILS", you'll notice Mr. Rogers’s status is SUSPENDED. Which begs the question; why does ones law license get suspended? (Since breaking this story, Rogers has updated his license and is now calling himself a lawyer. We have contacted to state bar association to raise questions as to how the bar can justify a license when so many are calling out Kelly Rogers on his business dealings and actions?)

We dug a little deeper into this issue. After all, someone who claimed in 2005 to have an "Extensive Knowledge of Securities and Exchange Law" would surely know how to keep a law license current. At least one would think so. However, this is not the case. On March 25th, 2002, the Texas Supreme Court issued Misc docket no 02-9063 ordering the suspension of Kelly G Rogers of Frisco Texas among others. His name is found under "COLLIN COUNTY", the same county who issued an indictment of Kelly Gordon Rogers on August 3rd, 2009. His State Bar number is listed as 17194020 and we crossed checked the number against the Kos Final Judgment and found it was accurate.

The Supreme Court of Texas has established a "minimum level of requirements" to maintain a basics of a law practice. The basic requirements are outlined in Misc. Docket No. 06-9075. In this order, the Supreme Court observes; "Despite notice and the availability of the Guide to the Basics of Law Practice course, many Texas attorneys have failed to heed this Court’s orders requiring attendance". Mr. Rogers has failed to meet the MINIMUM requirements in both 2002 and 2008. Having established this failure, let's look at how Mr. Rogers utilizes the status of being a "Lawyer" to build credibility in the community.

Free Market Foundation

The Free Market Foundation's Board of Directors listed Kelly Rogers as the
Secretary. He's is also listed as an Esquire, meaning a lawyer. OK, so is it wrong to list yourself as an Esquire even though you've been suspended by the Texas Supreme court? Probably not. However, the willingness to be listed as an Esquire, while knowing your license has been suspended, demonstrates a weird kind of need to have the "appearance" of being lawyer. It's almost seems like kind of badge of honor to build up his credibility.

We found the attached document on the internet back in January 5th, 2009 listing Kelly G Rogers as the secretary of Free Market Foundation. Mr. Rogers lists himself as Esquire, Frisco Texas. Based on this information, one has to ask themselves if the Free Market Foundation knew Rogers had been suspended. Did they know Mr. Rogers had been sued by the SEC for his part as a "Facilitator" in an illegal ponzi scheme, case 07-CV-346? Did they know that Mr. Rogers sold investment opportunities to his friends, business associates and strangers that resulted in the loss of millions of dollars? Did they know that for many, it cost people their life savings? Did they know the Rogers is being sued by a variety of disgruntled individuals and corporate entities?

To the credit of the Free Market Foundation, they must have figured it out. If you link to the "About Us" site today, Kelly Rogers is no longer listed as Secretary. Good for them!!

Legacy Christian Academy

On November 3rd, 2007 the Legacy Christian Academy hosted its "Legacy of Champions” Auction event. We've attached the brochure from that event. On page 6 of the handout, the 2007-2008 Board of Directors are listed and none other than Kelly Rogers name appears as a board member.

This raises a host of questions that need to be directed to Legacy Christian Academy. The obvious questions is how well do they know Kelly Gordon Rogers and are they aware of his actions from 2004-2009 that have resulted in a flurry of lawsuits against him? Has anyone pointed this out to fine institution?

And is he still listed part of the board in 2009? Further, are they aware of the following;

1. Do you know that Kelly Rogers has been indicted on a Felony 1 count by the State of Texas? Go to the State of Texas site and enter the name of Rogers, Kelly to see the current proceedings.

2. Do they know he was sued by the SEC as a result of his role as a facilitator in a ponzi scheme?

3. Do they know he raised money for a variety of business entities that are mostly bankrupt today?

4. Do they know that many investors solicited by Kelly Rogers lost their life savings, have been forced to file
bankruptcy and lost valuable relationships due to his actions?

5. Do they know he's being sued by many is his Amway business?

6. Do they know a he filed bankruptcy in July of 2009, owning others $6.5 Million?

It would be interesting to find our if he's still on the Board of Directors? However, they may not know about all this public information so let's hope our goal of protecting the public and presenting the truth has a positive effect in this situation. Only time will tell.

Kelly G Rogers of Texas files Bankruptcy on July 27, 2009

On July 27, 2009, Kelly Gordon Rogers of Texas filed Chapter 11 in the United States Bankruptcy Court. A Chapter 11 filing takes place when an individual or corporation cannot pay it's creditors. The idea is that the debtor's income can continue so they can pay off creditors. The entire process is conducted under court supervision. (See Update II, Update III and Update IV)

The case 09-42152 was filed in the Eastern District of Texas, a Voluntary Bankruptcy. Two subsequent documents were filed: Chapter 11 statement of current income and Summary of Schedules. Many of these documents can be found at the Collin County Clerks website at http://www.co.collin.tx.us/offline_status.jsp. Here you can find a complete listing of liens and actions, all recorded and accessible to the public.

Total assets listed for Mr. Rogers total $3,273,975.00 while money owed to creditors totals $6,458,794.38. Total estimated income for Mr. Rogers is listed at $30,000 per month and his spouse, who was not included in the filing, has an estimated $45,000 per month. Income listed for the year 2007 was $756,587 and $588,012 for 2008. Income sources were listed as Quixtar and Noble Royalties and Oil Reserves (Make sure to check out the last line of the Noble Royalties link about contacting Kelly Rogers for more information).

Property included as 'exempt' totals $3,160,000 including a home listed on the attached website at $3,250,000. Additional photo's have been included;

Creditors holding secured claims against Kelly Gordon Rogers are no fewer than 3 lenders totalling $1,857,000, while 6 full pages are dedicated to others owed. In total, 24 creditors have secured claims against the above listed property including; unpaid property taxes totalling $6,961, unpaid Frisco school taxes in the amount of $12,208 unpaid time share fees and mechanics liens for renovations of the home.

Unsecured priority claims include $13,266 to the IRS. Additionally, unsecured non priority claims amount to 9 pages overall. Included are 2 law firms, one in Boston for $28,263 and the other in Dallas for $77,934, 18 listed as lawsuits, a variety of vendors who worked on the remodel, a charge for a lavish elevator and a host of others. In total, 42 individuals or companies are owed money. Ironically, one of the creditors listed is Kelly Gordon Rogers own company, Falcon Energy, LLC.

As a strategy against Mr. Rogers filing, one group of creditors have filed a Motion for Rule 2004 Examination of Kelly Gordon Rogers with the Bankruptcy court. This motion extends the scope of examination beyond the normal rules and is equated to a "fishing expedition" for the purpose of discovering assets and unearthing frauds.

This bankruptcy filing comes at a convenient time for Mr. Rogers. Not only is he embroiled in a variety of lawsuits, he was indicted on July 30th of 2009 by the grand jury in Collin County. Based on the rash of lawsuits against him, it would appear Kelly Rogers has a history of finanical wrong doing. History shows he was sued in 2007 by the SEC for playing a role as a "Facilitator" in a Ponzie Scheme. The Scheme was shut down in 2006 but not before countless friends and associates were wiped out as a result of these fraudulant investments. In 2009, the trail of persoanal bankruptcies and financial devistation is still being felt by many. While the SEC eventually ordered him to pay disgorgement of $100,000, prejudgement interest of $3,360 and a civil penalty of $50,000, it has not stop him from continuing his "Deals".

According to the site, the offense took place on March 1st, 2005 and is a FELONY 1 charge. The charges include 26990034 Misapp Fiduc/Finan Prop >=$200,000. An arrest warrant was issued, then executed on August 14th. Rogers was booked, his mug shot taken and he was incarcerated. He was later released on $50,000 bond. Mr. Rogers is scheduled to appear on September 2nd, 2009 in the 380th District Federal Court, the honorable Suzanne Wooten will be presiding.

Ironically, Mr. Rogers birthday is listed as September 2nd, 1958. This is the date he's scheduled to make his first appearance in court! I wonder if the court will pause to sign happy birthday to this young man? Please continue to watch the Collin County website for continuing news and updates.

This is not the first time Rogers has been in legal trouble. In July of 2007, the SEC filed a complaint against Mr. Rogers for his role as a facilitator in a Ponzie Scheme. Mr. Rogers created a company called "Level Par" and solely responsible for investing with CR Davis and Global Finance and Investments. The SEC sued and won against Mr. Rogers who agreed to a final judgement that permanently restrains and enjoins Defendant from violation of several codes from the Securities act of 1933. These codes include Sections 5(a), 5(c) and 17(a). Also included was Sections 77e(a), 77e(c) and 77q(a) and Sections 10(b) and rule 10b-5.

Mr Rogers was ordered to pay disgorgement in the amount of $100,000 plus prejudgement interest thereon in the amount of $3,360 and a civil penalty in the amount of $50,000. The SEC rulings can be viewed below.
A link is also provided to a letter issued to all Level Par investors on August of 2006. This letter announced the SEC had contacted Level Par officials to report investments made by Kelly Rogers into entities run by CR Davis and Global Finance. These individuals and entities were part of an ongoing investigation by the SEC for operating as a Ponzie Scheme. The letter also documents $200,000 Mr. Rogers removed from Rio Grand Mining (a venture capital operation) and invested in the Travis Correll Ponzie Scheme in 2004. Shortly after details began to surface, Mr. Rogers was removed from Level Par and several other entities run by Richard Weyand. Several lawsuits were filed against Kelly Rogers in the subsequent years and these will be fully explored in the coming weeks.

Updates on these and other matters will be provided in the weeks and months ahead. Additionally, Kelly G Rogers personally filed Chapter 11 bankruptcy on July 27th, 2009 in the name of Kelly Gordon Rogers. This will be the subject of the next posting.
