Who do you believe--Kelly G Rogers or Avie DeSwardt?

I'm giving you, our readers, a homework assignment today. Read these two comments and simply tell us who you believe?

On August 02, 2009, Kelly Rogers wrote the following on the Ripoff Report about A.D. Design; 

DO not have your cabinets done by Avie De Swardt or A. D. Designs. He is a swindler and a fraud. He will take your deposit and not deliver your cabinets. If he does deliver any cabinets they will be substandard, different than what you ordered, and he will not care.

He will make promises to you to make you believe that his work is the best in the industry. Then he will steal your money, refuse to take your calls, agree to meet with you and fail to show up, and never meet his promised dates for delivery and installation. 

Then he will try to intimidate you with his size and threaten you into accepting his sorry excuse for cabinets, and then he will file a lien against you if you don't pay him for what he failed to deliver.

TO WHOM IT MAY CONCERN.
 
I have only filed a lien on one persons property in my 22 years in business. That was against Mr. Kelly Rogers. I filed the lien for one reason only and that is because he didn't pay me. 

My builder on the project was Mr. Mike Brown had advised me to file a lien as he (Home owner Kelly Rogers) was not paying him either or his bills. Mr. Mike Brown of MJB Homes can be contacted at 214-236-2617 to confirm this information. 

Mr. Kelly Rogers was sued by my lawyers at Higgier & Allen in Dallas and we settled. The outstanding money owed to my company by Rogers was delivered to my lawyers office before the case went to court.

I, Avie De Swardt, settled for about 40 cents on the dollar so I was the only one who lost money here. I believe my builder/customer Mr. Brown lost in excess of $100,000 that was owed to him by Mr. Rogers. I also did not get a final payment of approximately $1500 from Rogers and did not bother to pursue it and just moved on. 


The only truth about his report is that I did run into him afterwards at a Costco and I was rude to him in front of his wife, however, I did not threaten him in any way.  I did insult him and that's probably why he filed this nonsense to try and hurt me or my company. I can send you a customer list of a few hundred if needed so your office can make this false report disappear.

Kelly G Rogers retains James P. Whalen

Today on the Collin County website, a letter of representation was submitted to the court to retain James P. Whalen on Kelly G Rogers defense team.

So the question becomes; Where is Rogers getting the money to retain this guy?

If you study Attorney Kelly Rogers' track record, he's stiffed more lawyers than he's paid (Scheef & Stone, LLP $77,934/ Fish & Richardson, PC $28,264). So where's this newly attained wealth originating?

Is Rogers raising more Oil and Gas money? Is he working for someone, knocking down big six-figure income? Or selling his body to raise money? Is he back working for Scott Noble at Noble Royalties?

Prosecution prepares for Kelly Rogers' trial

According to the Collin County Website, the prosecution team has begin preparing for the trial of Attorney Kelly G Rogers.

The trial is set for May 19th, 2014 and prosecutors have asked the Honorable Mark Rusch the trial date be set in concrete after an ongoing effort by team Rogers to delay. Our understanding is that request was granted.

On March 25th, the State applied for 34 Subpoenas which have begun to be served. Stand by for justice to be served.

Scammer Kevin Trudeau Gets 10 years in Prison

Kevin Trudeau was sentenced to 10 years for bilking consumers through his TV infomercials.

Judge Ronald Guzman handed down a 10-year prison sentence at Monday's federal hearing.

Defense lawyers had argued the 50-year-old from suburban Chicago should serve less than two years for his criminal-contempt conviction. However, Judge Guzman delivered a sentence duration recommended by the prosecution.
 
In a scathing filing last week, prosecutors called Trudeau "an unrepentant ... huckster" and said they could think of no comparable case of someone cheating people so brazenly. The defense called the characterization "overblown and unfair."

In November, jurors convicted Trudeau for defying a court order barring him from running infomercials that made false claims about his book, "The Weight Loss Cure They Don't Want You to Know About."

Prosecutors say he aired the infomercials anyway, at least 32,000 times.

In a similar fashion, Kelly G Rogers reached an agreed settlement with the SEC back in 2007. Yet, unrepentant, he continued to offer and sell fraudulent securities to unsuspecting investors.

Let's see if Rogers gets a similar sentence as the "Huckster" Trudeau received. We can only keep our fingers crossed.

Kelly Rogers gives Kelly Rogers a run for his money!


26-year-old of FL Has Been Charged - Kelly Rogers of Volusia County
 
On Wednesday, March 12th, 2014, Florida Busted! obtained records showing that Kelly Rogers, of Volusia County, FL, was taken into custody by Florida officials.
 
Official Florida public records obtained by Florida Busted! from the Volusia County Sheriff's Office indicate that the woman, Rogers, was charged on Wednesday, March 12th, 2014. She has been charged on multiple counts. Of particular note, when Florida Busted! conducted a background check for Kelly Rogers, we located zero possible previous arrests for Rogers.
 
Rogers, DOB 12/05/1987, was described as a white woman of 26 years age. Florida Busted! will update this story as more information becomes available.

The Logic Behind Attorney Kelly G Rogers and Mitchell R Nolte's Delay Strategy

Today I received an anonymous email. It laid out a theory as to what's behind the strategy of delay, delay, delay executed by Der Slick Meister and his lawyer Mitchell Nolte. 
 
I have no idea who sent it but it makes perfect sense and I had to share it with all you legal eagles. It goes something like this:

This is an election year. The Collin County primaries are scheduled for March 4th, 2014 with the main election this fall. The District Attorney and a bunch of judges are up for reelection including;
  • Greg Willis - District Attorney
  • Scott Becker - Judge of 219th District Court
  • John Roach Jr.- Judge of 296th District Court 
  • Ray Wheless- Judge of 366th District Court
  • Cynthia Wheless- Judge of 417th District Court
  • Jill Willis- Judge of 429th District Court
One of those Judges NOT up for reelection is Judge Mark Rusch.
 
However, when an election takes place, opportunities present themselves for individuals to move up and better their careers. They fill positions vacated during the normal election cycle.
 
So lets assume for a minute that Kelly G. Rogers and Mitchell Nolte have read the tea leaves and know Judge Rusch is going to blast Rogers with both barrels.
 
They know Kelly G Rogers will be the quintessential example of what happens to vultures who pray on friends, neighbors, fellow parishioners and the business community at large.
 
While it's a jury who'll decide the sentence, it's the Judge who holds discretion over whether each count will be served "Consecutively" or "Concurrently" and many other responsibilities.   
 
But let's assume he's in line to get a sentence similar to Karen Bowie who got 80 years in confinement in the TDCJ. They know he's going to jail, it's just a question of how long.
 
So by delaying, maybe they can catch a break and Judge Rusch gets elevated to a new position. The theory goes that a new kinder, gentler judge is assigned or elected and would go soft on Rogers because they don't have the same view on justice as Judge Rusch. As a result, Rogers gets only 5 years rather than 80.
 
So while I couldn't believe what I was reading, it did make a lot of sense to me. So what are your thoughts?  Is it possible? Someone please tell me that it's not possible! Yuck.

What's going on at 8 Riva Ridge?

There's a great app for seeing who lives in your neighborhood. It's called "White Pages Neighbors". You simply enter your address and it provides a complete rundown of who lives in your neighborhood. That is, except if your Kelly G Rogers.

Kelly G Rogers no longer exists in his neighborhood. If you enter the Rogers current address at 18 Stonebriar Way, Frisco, TX you only get Carrie Rogers. Doesn't Kelly live here anymore?


But it gets way more interesting when you enter 8 Riva Ridge. An error occurs in the program? That's curious.
 
We reported last week that according to Zillow, the bank foreclosed on the property on 9/8/2010 and the lender purchased the property for $1,400,000. The bank resold the home to someone on 1/17/2012 for $1,856,250. Yet, no one has moved in, which seems very peculiar.

We posed the question; who drops almost $2.0 Million and then leaves a house empty for 2 years?

Do a reverse lookup on Attorney Kelly Rogers cell phone 214-837-0000, his Stonebriar Way address appears as his business office address. So who owns Riva Ridge? Anyone know?
